[Resolved]  Tanaji Malusare City (Tmc) — No progress from last three years

I have booked Flat in above referred Project. They have taken amount for the work. Now almost three years, and there is no progress in work. If visit to site, you can see same work is going on. Now there is doubt about the project. Is Tanaji Malusare City is jenuine ? They have closed their registered office of Belapur and shifted to Karjat on site. Never get satisfied answer when the project will get shape. There answer is financial problem. They took money from people upto foundation level. We do not have any source for right information about TMC. Our Flat is registered, all legal documents are there. But now no faith on TMC Project. I got letter from unknow person that this project is fraud. How outside people gets our addresses as we are TMC Flat holders ?

I am a flat owner at TMC after paying Rs.2, 81, 000 /- there is absolutely no progress.I was told if I cancel my registration my money will be returned withing 6 months .After the rigorous procedure and not to mention additional money spnt on cancelling my agreement, I am still waiting for my money to be returned.I am totally convinces YMC are rogues.

Tanaji Malusare city.Karjat — Cancellation Refund still not received

I had cancelled my 2 BHK Flat at TMC,Karjat all the cancellation procedure are done but i havent received by money yet,I was told to wait for 8 month after cancellation and still the payment is not paid by TMC.Please look into this
After cancellation procedure of Flat of TMC, Karjat.I was told that they will refund the money to me after 8 months.Still not received the money.

We were introduced to this project through advertisment/internet in 2010. The project named "Tanaji Malusare City" and claimed to be India’s first affordable housing project, spread over 100 acres located in village Shirse and Akurle of Karjat. The project when completed, will have 24, 000 homes and would house approximately over 70, 000 people.

This was a housing project for low and middle income groups and already 4, 500 individuals have booked apartments and paid between Rs.4 to 5 lacs.

We were informed that our apartment would be ready for possession in 2011, which did not happen. The builder is following up for payments and despite repeated followin up has refused to indicate a firm readiness date.

Meanwhile we learnt that the builder has put up the land admeasuring 100 acres for sale and the notice for the same appeared in Raigad Times on March 9, 2012. It is understood that several buyers have registerd their objection for sale with the advocate indicated in the notice. We also got in touch with an advocate in Karjat, Mr. Madhukar Vajantri (Cell no. [protected] / mail ID [protected]@yahoo.com) and learnt from him that he is representing several buyers in the Consumer Court at Alibagh. He explains that local authorities have refused to take cognizance of this scandal.

Mr. Joe Silva representing the promoters appears to be engaged in not only the TMC project, but another project in Karjat viz. Tuscany Terraces. Buyers in this project are also in the process of filing criminal compliant against the above.

We would like to encourage HT to use its reach to investigate and expose this scandal. Joe Silva is understood to have taken loan of over Rs.20 crores from IDBI Bank and defaulted in payment of instalments.

Joe Silva has been associated with several companies, some of which are M/s. Gopi Resorts Pvt. Ltd., Matheran Realty, Eredene Capital, Silvex Realty.

There is also an interesting piece of article on the net pertaining to Eredene Capital PLC (www.eredene.com) which is a UK based company with impressive investments. Apparently they as shareholders in Gopi Resorts and Matheran Realty had a dispute and had a ruling in a UK court with whch the shareholder dispute relating to its investment in low-cost housing developer, Matheran Realty. Following a judgement in its favour by the Company Law Board in Mumbai and an award in its favour from the London Court of International Arbitration, the Eredene Group has settled the dispute and, in accordance with the award, paid Alibante Development Ltd £2.6m for its 42% stake in Matheran Realty. The settlement means the Eredene Group now owns 87% of Matheran Realty, with the other 13% held by a local developer. The Eredene Group also directly owns 32% of Matheran Realty's subsidiary Gopi Resorts Pvt Ltd ("Gopi Resorts"), with the remaining 68% held by Matheran Realty. The settlement takes the Eredene Group's overall investment in the two companies to £15.3m.

Matheran Realty's subsidiary, Gopi Resorts, is developing a large low-cost housing project on a greenfield site at Tanaji Malusare City near Mumbai where sales deposits have been made on some 3, 600 units. The Eredene Group has retained a leading international real estate advisory firm to assist in realising its entire interest in the development.

Eredene has investments in Matheran Realty Pvt Ltd and its subsidiary Gopi Resorts Pvt Ltd which is developing a low-cost housing complex at Tanaji Malusare City near Mumbai, where deposits have been taken on some 3, 600 units.

Construction has been held up pending resolution of a long-standing shareholder dispute. The dispute was settled in July 2012 following rulings in Eredene’s favour, and Eredene has subsequently put the entire development up for sale.

It is shocking to note that even today representatives from TMC project call prospective buyers offering to book apartments with assurances of possession by 2013/2014. You may like to call their representatives on[protected] and check.

I want to take some action against them - either take them to court.. or break their bones - becuase I read in some other posts that some buyers who were pushing them for answers were threatened by bouncers!!! I think I am the latest victim of Silvex. One person named Mr Sujeet Ghosh VP Sales - Phalcomm came to me with this proposal one year back. Phalcomm has now become Klickbrick and both companies are subsidiary of Brickeagle which is a famous PE. They showed me an apartment which is ready for possession. I made a downpayment, got a loan sanction and also paid money for stampduty and registration. Later they told that the flat had been sold earlier to another person and they had filed a suit against the old buyer but the case is unsettled. So I cannot register the apartment in my name. Now, they are not even refunding the money back. The sales broker also has backed out.

Also they are now selling another township called Sheltrex project which is a township in Karjat. They have put up a demo house also at Viviana Mall in Thane. Earlier the demos were going on at Inorbit Mall Vashi. Let us all gather and go to Viviaana Mall so that new buyers can be beware and we need to bring this to the notice of media. If anyone has filed a legal case, please give me the details of it as I also intend to do the same. My email address is [protected]@gmail.com.
