Respected Sir/Madam,

I, Ashish Kumar Gupta, am filing this complaint against CrossBeats regarding false and misleading product specifications, misrepresentation of software version, and inconsistencies between advertised and delivered product features.

Details of the Complaint:

I purchased the CrossBeats Lumex Vista Projector, based on the specifications advertised and shared by the company, which clearly stated the device runs on Android 13. Prior to purchase, I even received confirmation from CrossBeats Support about this Android version.

However, after receiving and setting up the device, I was shocked to discover the projector actually runs on Android 9, not Android 13 as promised. This contradicts both the marketing materials and direct communication I had before purchasing.

To make matters worse:

The user interface (UI) and overall experience of the projector is significantly different from what was shown in the promotional images and videos on the website.

The UI appears outdated, less functional, and is not consistent with what one would expect from an Android 13-based device.

This adds to the evidence that the product has been misrepresented on multiple fronts.

When I contacted CrossBeats Support, they responded stating that the projector comes with Android 9 — with no apology, acknowledgment of misinformation, or proposed resolution. The support response also included a dismissive remark: “Thank you for understanding.” I would like to make it clear that I do not understand nor accept being misled as a customer.

Violation of Consumer Rights:

This incident clearly falls under:

False advertising

Unfair trade practices

Misrepresentation of product specifications

Failure to provide agreed-upon features

Such practices are in direct violation of the Consumer Protection Act, 2019, and damage consumer trust and rights.

Relief/Resolution Requested:

I respectfully request the Hon’ble Consumer Forum to take appropriate action and direct CrossBeats to:

Issue a full refund or provide a replacement product that accurately meets the originally promised specifications (including Android 13 and the advertised UI).

Provide a written apology and formally acknowledge the misrepresentation.

Offer reasonable compensation for the mental distress, wasted time, and inconvenience caused.

Be directed to correct or remove false specifications and misleading promotional content from its website and product listings to prevent future consumer deception.
