REQUEST FOR REFUND OF ₹16, 000 FOR MISREPRESENTATION / MIS-SELLING AND MATERIAL DIFFERENCE IN PROMISED SERVICES Consumer:Bineesh T . Company to which Amount is paid: Eternal trips Amount paid: ₹16, 000 Membership period:** 15/08/2026 to 15/08/2027 I wish to register a consumer grievance against Eternal Trips Private Limited regarding the sale of a holiday membership for ₹16, 000. I purchased the membership based on specific mis representations and assurances made by the company's sales representative, Hardik Desai . Phne : [protected]Emp Code ET0213 .Ph: [protected]. The representations made to me were an important factor in my decision to make the payment. 1. Written assurance that there were no hidden charges Before making the payment, I specifically asked the company's sales representative Hardik whether there would be any hidden/additional charges. Hardik expressly replied to me on WhatsApp: “Nahi, koi hidden charges nahi hein, clear mana kar raha hu aapko there is no hidden charge.”He also promised me i can book 2 rooms together which was also a lie. Therefore, I proceeded with the purchase relying on the specific written assurance that there would be no hidden charges. I have retained the original WhatsApp communication as evidence. 2. Additional ₹2, 000 per day demanded after payment. After purchasing the membership and subsequently attempting to make a booking, I was informed that I would have to pay an additional ₹2, 000 per day as a “utility charge”. This was not represented to me by the sales representative as an additional payment that I would have to make. In fact, the representative expressly assured me in writing that there were no hidden charges. Additional 2000 per day for 12 days will cost me additional 24000 Rs. So considering I already paid 16000, the total package cost will be 40000Rs. They could have mentioned it before.I believe that the demand for an additional ₹2, 000 per day after payment is materially inconsistent with the representation on which I purchased the membership. 3. Kochi hotels in the supplied property list are different from the hotels now offered . Before making payment they lured me by sending a pdf of 4 star hotels stating that these hotels will only be booked. But after making payment the hotels mentioned in the pdf are not there. Small motels are added and i was given a choice if you wan tyou can take this by paying 2000 rs per day additional. Before payment, For Cochin they mentioned The Renai Cochin • The PGS Vedanta • The Dunes Cochin • Bloom Boutique Hotel • Nihara Resort & Spa.All 4 star hotels with breakfast & dinner. However, when I requested a booking, Eternal Trips informed me that the available Kochi properties were: • Blooms Cochin( which is a motel) • Quality Airport Hotel – Breakfast + Dinner • Diana Heights – Breakfast only. The three properties currently being offered to me are not the properties listed under Kochi in the property list supplied to me. Therefore, the accommodation options being offered after payment are materially different from the property list that was provided to me when I purchased the membership. 4. Breakfast + Dinner benefit is also not being consistently provided My membership document states: “10 Nights + 2 Nights in India” and “Nights Utilization Every Year 10N/11D (Breakfast + Dinner)”. However, Diana Heights is currently being offered to me with **Breakfast only**. This is another material difference between the stated membership benefit and the service currently being offered. My complaint is that: (a) I specifically asked the sales representative whether there were hidden/additional charges; (b) the representative expressly assured me in writing that there were no hidden charges; (c) I relied on that representation and paid ₹16, 000; (d) after payment, an additional ₹2, 000-per-day charge was demanded; (e) the Kochi properties being offered do not correspond with the Kochi properties in the property list supplied to me. I therefore believe that I was induced to purchase the membership based on representations that do not correspond with the service now being offered. I request the National Consumer Helpline to take up this grievance with Eternal Trips Private Limited and seek: 1. **Cancellation of my membership.** 2. **Full refund of the ₹16, 000 paid by me.** 3. Appropriate action regarding the representations made by the company's sales representative concerning hidden charges and the accommodation offered. 4. Appropriate relief for the inconvenience and loss of time caused by the above conduct, if considered appropriate. Was this information helpful? |
