Fox Online Solutions (Exprestore) — Non-payment of outstanding dues, cheating & fraud

This complaint is against Ashish Agarwal, owner of Exprestore, which is under the registered business name Fox Online Solutions, a software company based in Bangalore. Facebook site: https://www.facebook.com/Exprestore Exprestore set up an online Facebook store for my brand Omnah (www.facebook.com/omnah) in September 2013, for a value of Rs 15, 196/-, using the payment gateway of EBS India. (https://www.ebs.in/en/) As per the agreement, all monies from successful online sales from Omnah would be first routed to Exprestore, which means when a customer buys a product from Omnah’s online store customer's payment would go to Exprestore. They promised that these sale monies would then be transferred back to my account - YES Bank, within 48 hours of each online sale transaction. Over the last 18 months, for every online sale transaction Exprestore has delayed my payments, some times up to 3-4 weeks. When calls are made to request payment, Ashish Agarwal has threatened me with "we will shut down your store" and many lies over the days after each transaction from saying “we have already paid, please check your account” to “your bank details are wrong” etc. I am running a small business from home, and if Exprestore is consistently delaying payments and conducting business unethically, it affects my business too. The latest online transaction occurred on 23 Feb 2015, from a customer in Himachal Pradesh, transaction amount Rs 1, 900/-. Exprestore’s system is not working as promised. 1. The sold item still shows as available, which can be misleading to other customers 2. No notification sent to me (Omnah) or the buyer regarding this transaction. This alerts me for shipping out the product to customer. I was only made aware of this transaction when customer called me on Monday, 9 March. 3. Payment of Rs 1900 is already made by buyer to Exprestore 4. Exprestore has not paid the amount amount back to me for nearly 20 days, giving me several invalid reasons, including that EBS (the payment gateway) has not paid them. Exprestore has been lying and fabricating stories everyday since I highlighted the above issues on Monday, 9 March 2015, to Ashish Agarwal. Finally, as I was really fed up of dealing with dealing with his rude and threatening attitude, I called the EBS hotline. My findings revealed that EBS has already paid them on 7 March, so I don’t see why Exprestore is not releasing my payment. I was also told by EBS that there were other Exprestore customers who called EBS with a similar complaint of non-payment, payment delays and lies. In view of the above unethical business practices by Ashish Agarwal & Exprestore, I request that the consumer court investigates this company, and hope that they are asked to close their business so that other unsuspecting customers using their online e-store system do not suffer the same fate & lose their invested monies and proceeds from online sales.
