Dear Mr. Redia,
Sub: Grievances of Magic Hills Residents
We, the owners of bungalows at Magic Hills (MH) are shocked to receive your email stating that we owe you maintenance charges towards our bungalow maintenance from April 2016 to March 2019.
We are unable to understand on what basis are you asking for the maintenance charges? As you have not completed terms and conditions ofthe contract signed by us with your company. Can you give us in writing that you have fulfilled your obligations as per the signed contracts?
Most of the owners have expressed their great agony upon witnessing the current state of their bungalows. They could not even take their car to the porch because of the wild thorny plants grown in the middle of the road leading to the porch inside the bungalow area. The whole MH appeared to be a ghost town and most of the bungalows are in a pathetic state appearing to look like a big haunted place. We are even scared to get down from our car and walk on the road due to fear of reptiles or wild animals around. The paint/plasters of the living room and other rooms are peeling apart and falling because of the poor quality of materials used. Roof is leaking. Doors are damaged as they are of very poor quality. Roof tiles have broken. Sir, not even our wildest dreams we could imagine that the condition of the bungalow and surrounding area will be this bad given all the promises and marketing material you flaunted in front o[censored]s before and during we signed the contracts. Clearly from our perspective you have not fulfilled your obligation under the contract we all have with your company
Some of the owners who are either currently staying at MH or spending weekends have narrated their horrendous experience and now repent for having invested in MH. Several owners are not at all happy with the way their grievances are addressed by Garnet.
We would like to bring to your attention the following concerns:
L There is no security service at the MH Complex as we understand that the security personnel have gone on strike due to non-payment of their salaries for the last few months. This is a basic and major concern for the owners currently staying in MH.
2. The construction materials used by Garnet are of a very poor quality as heavy cracks have appeared on all the walls of their bungalow both inside and outside. We demand a home quality expert should validate the quality of the construction against the promises you made.
3. Most of the bungalows appear to be in a very bad shape — roof tiles are missing or broken, plasters of the walls both from inside and outside falling apart and roof heavily leaking from inside because no water proofing has been done. Again, this should be subject to quality verification through a home quality expert.
4. The roads inside the MHC are in a very bad condition, very weak and in a rough state. The marketing material and promises you made during purchase are not consistent with the current state. If we knew this would be the state, we would not have agreed to purchase the properties.
5. There is no electricity throughout MH and owners need to install additional inverter or solar arrangement on their own. Garnet is not bothered to provide any solution to this issue.
6. Water quality is very poor — contaminated. This is a serious health and well-being issue for all owners.
7. The plants and electrical poles are in a very bad shape. This is a safety hazard. Plants are totally burnt and the whole MH appear to look yellow as if they are burnt.
8. One cannot procure the basic day to day groceries or essential stuff within the vicinity and have to travel miles to get their ends meet.
9. MH has a lot of wild cats and stray dogs including reptiles that are moving freely.
10. There is no sight of the Club house.
11. Overall MH looks very ugly compared to what was sold as goods. 12. There appear to be more sand vs. cement in construction due to which walls of most of the bungalows are crumbling and waterproofing is not done at all.
13. We have not seen any signs of any infrastructure development taking place around the area such as connecting service road from the Mumbai-Pune Expressway to MH. This was promised to us at the time of booking the property in the brochure. For most o[censored]s this was very important point for buying the property.
14. Over last several years there is no evidence of MH is not taking any initiative to complete the project in a professional manner and hand over all the bungalows to their owners.
15. Some of the owners who had invested in Magic Heavens are still stranded and awaiting to get their refunds. The project never took off but Garnet have taken a good amount of money as an advance towards that project.
16. We understand that you have shelved Magic Heaven after taking crores of rupees as advance. Instead of completing Magic Heaven, you started another project at the same location under the name 'Blossoms' and started marketing it to other investors. This is very serious and we understand that few customers have already informed the relevant authorities. It is in your interest that you come clean.
17. Compensation to the owners (interest) due to severe delays in handing over the bungalows to the owners.
We all have now decided to join hands and raise our issue with the concerned authorities to ensure that our basic rights are honored. This includes the following:
1. We will hire a law firm to address our basic rights and woes.
2. We will invite social media and press and let them see the plight of the bungalow owners.
3. Visit the Gram Panchayat office to register our complaint.
4. We will complain to the MAHARERA as we have been taken for granted by Garnet by not providing us with basic amenities as promised.
5. File a suit against Garnet in the court of law.
6. Filing FIR against Garnet owners and employees at relevant police stations for fraudulent magic heaven project.
7. We will also implicate both Sternon Dubai and Sternon India as a company that has given false promises to NRIs and made them invest money in a project that promised delivery in 3 years. It is now more than 11 years that the project is still not habitable.
We clearly wish to advise you that we all have lost our faith and confidence with Garnet and now prepared to take up the matters through appropriate available channels to ensure our grievances are addressed.
Please let us know within two weeks how Garnet proposes to remedy the situation to make the MH a place where we can peacefully inhabit, enjoy fruits of our hard-earned money and feel you fulfilled all promises you made during contract signing are fulfilled, failing which we will be compelled to initiate the above proceedings.
All the owners have claim going into crores for misrepresentation, shoddy construction that is risk to health and safety, not completing the project until now. We reserve our rights to claim in full including interests, costs and any expense whatsoever. We also reserve our right to secure our interest by seeking court order to attach your properties.
