Gayatri Hospitality And Realcon Ltd., H-133, Sector-63, Noida - 201 301 (up) — Fraud by the builder - Flat not constructed/money not refunded.

I had booked a 3BHK Flat of 1195 Sq.Ft with M/s. Gayatri Hospitality & Realcon Ltd., Noida in December'2011. Builder had committed to deliver the Flat within a reasonable time of 36 months. Payment Plan opted was Construction Linked. Subsequently, the builder has changed the total plan and & dimensions, major changes in location, direction, design, size of Flat and other amenities. The builder has taken about 20-25% price of the Flat. About 54 months are elapsed but no appreciable progress is seen. Besides, builder has not executed builder-buyer agreement till date despite many requests & personal visits. Due to high degree o[censored]ncertainty involved in the project, I have already served a letter of withdrawal (dated 03.10.2015) from the project with a request to refund my deposited principal amount with due interest thereon @ 18% p.a. & a reasonable compensation and subsequently, I reminded them many times But, the builder only confirmed to refund deposit amount without any interest & compensation. Besides, the builder is asking to submit affidavit & NOC from broker with whom I had no agreement at all. Now, the builder is neither refunding the money with interest & compensation nor replying at all.

ECONOMIC DAMAGE:
1) Deposited Money: Rs.5, 35, 355/-
2) Interest due on Deposited money (to be calculated from the date of deposit.
3) Reasonable compensation for Loss of opportunity as presently I cannot get a comparable flat at the same price on which builder had agreed to charge from me 55 months back.
4) Physical & Mental torture due to abnormal delay and continue persuasion with the builder for Flat & Refund.
RELIEF WANT:
1) Refund of Total Deposited Money i.e. Rs. 5, 35, 355/-,
2) Interest due @ 18% as per principal terms & conditions of booking ( Rate of interest is taken at par the builder was entitled to recover in the event of delay on my part.
3) Reasonable compensation so that I can get the equivalent flat in same area(difference amount from booking price and present prevailing price for equivalent Flat)i.e. about Rs. 10-12 Lakh.
4) Compensation towards Physical & Mental torture due to abnormal delay and efforts for continue persuasion with the builder for Flat & Refund
