I have booked a flat in golden oppulence of golden homes chennai in 2011. They are supposed to handover the flats in dec 2015. To this dates flats are not ready as livable and the company is trying to force handover of their common facilities like swimming fool earlier in an unsafe manner without getting cc /noc in order to escape from rera. Still construction activities are carried out in gl. Roads /carparking/drainage/power supply facilities are not made ready.in the meantime, we as customers requested the management to furnish the customers list in order to form a proper owners association but they try to evade without giving the list telling as that is confidential.
Please advise whether the company's behaviour is right and what are the ways to demand the customers right under the present circumstances?.

i wait for them to reponse still they asked time till August 31 2017. If its not done reopen the case.

I have booked 2bhk flat no 6 tower 2 2nd floor 1093 sqft on 28.11.2012 by paying 10% of the flat amount, at the time they assured that the flat will be hand over in 2015 march, but whereas they mentioned in their agreement that it will be hand over in 2016, when questioned they said it will be handed over on or before 2015 this is only to safeguard of delay in natural calamities. i have paid 99% to the builder and got it registered in 2016 September.
when i approached for the keys for doing interior they refused and demanding the interest to the tune of 5L towards delay in payments. the awarded compensation of rs. 51000.00 for not handing over the flat in time..
i have sent replay to the golden homes as below.
dear golden homes after sales dept.
This is to inform you that we are not accepting your final bills under the following reasons.
1. We have not received any mails from you with regard to our earlier mail which sent to you on September 2017, subsequently we have sent more mails to you, for which you have not replied and kept quite.
2. At the time of registration on 7th of September 2016, you have not informed us about the interest part. If the interest is due, why you have not demanded and why you have not murmured anything about “so called interest”. I have paid 99% of the amount as per the agreement.
3. The inordinate delay on your part to handing over the flat causes much mental agony apart from heavy financial losses to me by way of paying unnecessary rent, EMI and heavy transport expenses. It is very unfortunate that you have realised the hardships caused to me because of your negligence on your part. In this scenario, the so called interested claimed by you is very atrocious.
4. At the time of booking you have promised to handover in 2015 march, even before signing the agreement when i raised the queries with regard to handing over the flat you promised me that the flat will be ready for handing over on or before 2015 march.
5. The compensation amount for the delay on your part in handing over is very meagre when compared to your claim “ so called interest” with regard to the alleged delay payment.
6. The corpus fund will be decided by the owners association at the time taking possession, the claim on your part is not reasonable and there is no bonafide on the claim.
7. The maintenance amount for the period of one year collecting in advance is not acceptable as we have not occupied the flat.
Further to the above we have to get rs.36379.00 from you the details given below. if not acceptable we are force to approach legal remedy to recover our flat and amount.
1. Referral bonus amount to be received is Rs. 87944.00
2. Amount due as per builders agreement 1% at the time of handing over of the key rs. 51565.00 (which includes tax)
The amount receivable from you rs. 36379.00.
Kindly arrange the payment immediately along with the key.
