Gramin Bank Of Aryavart — matm/pos machines technical issues not being taken up by vendor

Gramin bank of aryavart has purchased 2205 matm/pos machines from wipro and we have a legal agreement dated 22nd janauary 2014.
Clause 10 (B) of agreement states that "the warranty period of the deliverables shall be for 36 months from the date of commissioning of the machine i. E. From the date is testified that machine is working. The bank shall promptly notify the vendor in writing of any claims arising under this warranty. Upon receipt of such notice the vendor shall with all reasonable speed, repair or replace the defective deliverables or part thereof without cost to bank"
Clause 11 (B)- the vendor agrees and undertakes that upon expiry of the warranty period, the vendor shall, provide annual maintenance contact (Amc) to the bank at least for a period of 02 (Two) years from the said date, for amc for fees stated in schedule iv on such terms and conditions similar to that during period of warranty.

Clause 17 (A) this agreement shall commence from 25th november 2013 and continue for a period of 60 months from the said date i. E. Till 25th november 2018, unless terminated earlier...

In reference to above it is self explanatory that responsibility of repairing is with wipro till 25 november 2018.
Caluse (11 c) empowers bank to cahrge rs 50per day per micro atm of product base value - if it is non functional (Due to reasons solely attributable to bidder)

On the basis of above fact we hope that you will honour the agreement in true word and spirit.
Vision tek engineer is not responding for technical support for the machines starting with serial no.3121. So please look into the matter and resolve the isuue at the earliest.
