Subject: Fraud and cheating by M/s.Urbtech India Developers Pvt. Ltd. and M/s.Hi-Lead Infotech Pvt. Ltd. having office at 1098 Basement, Chitranjan Park, New Delhi-110019.
Above said companies jointly initiated Commercial Project as “NPX” (Nehru Place Extension), at Plot No.1, Block-C, Sec-153, Noida.,

Dear Sir,

We would like to inform you that in 2009, we got information of above said project through an advertisement. On contacting, the marketing person of above said company contacted us along with Brochure and tentative Floor Plans for above said project.

We visited the construction site and took initiative to book shops on Ground Floor. We submitted the application form along with a cheque of booking amount and finally booked the shops on Construction Linked Plan.

At the time of booking, two payment schemes were introduced. One was Construction Linked plan in which the payment was in instalments as per the construction grows. Another was assured return scheme in which the buyer paid 95% payment at the time of booking and rest amount was to be paid at the time of possession. But in this scheme buyer gets some return on their investment on monthly basis. This return should have been paid by the builder to buyer till the possession of the shop.

In 2011 builder provided Final Revised Floor Plans to the buyers. Builder was bound to construct the shops as per these Floor Plans.

This came into notice in mid 2012 that builder has stop giving the Assured Return to Assured Return Buyers and started giving the possession letters (document only) to Assured Return Buyers, while the building was under construction.

On this act of builder, the Assured Return Buyers tried to contact builder. The builder declined to meet and started passing time.

At the end of 2012, another act of builder came into notice that they started to make up a RAMP outside the main entry for direct entry to First Floor, while this RAMP was not the part of the proposed design.

Further builder started introducing this First Floor as Ground Floor to all buyers (who booked the shops in 2009-10 and the new buyers) who were approaching to builder to book shops at this stage.

During this time, the builder introduced another brochure also with a new cost. This time builder started showing First Floor (with RAMP) as Ground Floor to new buyers. Simultaneously builder started calling the original buyers of Ground Floor (who booked shops in 2009-10) to give back their shops at a higher price as compared to booking price of 2009-10. Builder started shifting original buyers of Ground Floor to their new residential project “XAVIER” by saying that investor will get good return on this project.

In 2013, builder started new practice with CLP Buyers. They started sending letter titled “Take Charge o[censored]nit” to selected buyers (For Example, our group of five buyers booked shops at the same time. Out of five, only me got this letter). In this stage also the building was under construction and no completion certificate was issued by the Noida authority so far. By sending such letters, one on one basis, builder tried forcibly to take documentary possession of shop on First Floor.

In the beginning of 2014, it was SHOCKING experience for GROUND FLOOR buyers (who booked shop in 2009-10) when the builder introduced a NEW FLOOR PLAN where they merged Ground Floor Shop numbers with First Floor Shop numbers on document and started showing physically all this at First Floor (which they already joined with a RAMP and self declared as Ground Floor in 2012).

Builder started illegal practice with Ground Floor original buyers to SNACH Ground Floor Shops from them and tried forcefully to give documentary possession of shops at First Floor where as we booked the Shops on GROUND FLOOR.

In above said facts and circumstances, it is pleaded that appropriate action is anticipated.
