I, Neha Tiwari, representing my father, Bharat Chandrama Dubey, and the slum dwellers of Harinagar, Jogeshwari (East), wish to draw your attention to the impending forced eviction and demolition of slums scheduled by Hub Town Builders Pvt Ltd in conjunction with Andheri K/E ward BMC and esteemed ward officers on March 4, 2024.
Regarding the road mapping for construction purposes, under the Project Affected People (PAP) policy, the affected individuals should be allocated housing within 3 km or 300 meters of their current location on a priority basis. This right to shelter, guaranteed under Article 19 (1) (e) of the Constitution, is being infringed upon by these rehabilitation efforts.
Despite having paid structure rent to BMC until 2024, the BMC ward officers are insisting on demolition, directing us to collect a cheque from the builders or relocate to Mahul (Chembur). Furthermore, the BMC's demolition orders issued on November 10, 2023, have expired, and subsequent notices lack legal validity.
We have pursued legal avenues by filing an appeal with the Slum Rehabilitation Authority (SRA), which was dismissed citing the impending demolition. Additionally, we have lodged a case in the Bombay High Court (Case No: 7110/24), which is still pending. The response from the court has been to await the demolition before further consideration.
My father, a diabetic, blood pressure, and heart patient, is under immense stress. Any adverse health outcome will hold the BMC K/E ward officers, SRA officer, and Hub Town builders accountable.
I have faith in the Constitution, my country, and its honorable ministers and officers. I implore the Indian Judiciary to expedite the resolution of our plight. While we support the SRA project, it must not come at the expense of our housing rights. We seek justice and a fair resolution to this situation.
