Jain Housing & Construction Pvt Ltd — Jains carlton creek apartments, hyderabad - 2 years delay in construction & handover; very poor quality

Jains Carlton Creek at Hyderabad was to be constructed and handed over by March 2015. Even now, in May-2017 the company has not done its job!

1. The quality of construction is very poor, design is bad, customer service = zero. After lot of discussions, we have given up on this builder to do what is promised!!

2. Management does not bother to respond on any queries and communication from company is only to seek money.

3. The agreement mentioned delayed payment of Rs 8/sft per month. Even after delaying the construction for ~2 years, builder doesn't talk about it.

4. Instead builder is demanding us to pay penalty 18% per annum penalty on the delayed stage due amount.

The facts:
(i) - We booked the flat in Dec-2014, initial agreement was signed in mid-Dec-2014. The home loan bank had approved the loan in Jan-2015 pending submission of property documents by builder. After rigorous follow-up, the documents were submitted by builder by last week of Mar-15. Promptly, the bank issued the cheque in Mar-15
(ii) - Funnily, builder didn't collect it for over two months while we had to pay the interest on the bank loan disbursed. While we were following up with them to collect the first cheque. We wrote a reminder mail in Jun-15 that cheque will expire soon, in reply they asked for next stage due amount stating it is overdue. (Don't you want to pick the 1st cheque disbursed by Bank!!)
(iii) - Now amazingly, the builder does not agree that delay in receipt of funds was due to their staff incompetence!!!
(we have already shared all the relevant emails to the builder)

Resolution required:
1. Handover the flat ASAP without harassing us further
2. Though builder had already collected maintenance money @ Rs. 120/sft for three years in advance, there is lack of security and basic amenities at the location. The builder's maintenance service are pathetic and need to be improved so that the location improves to livable condition.
