Jaypee Greens — Legal action against jaypee for delayed possession of flats

Dear friends,

Completion of the jaypee projects in noida is highly delayed, and negligible compensation is being provided. I am planning to initiate legal action against jaypee to receive appropriate compensation. This can be up to 18% per annum which comes to an additional rs. 45 lakhs compensation for a 5 year delay on a flat worth rs. 50 lakhs. This will also help in speeding up the possession. I have already spoken to a trusted lawyer in this regard and i believe that we have a strong case.

My lawyer has further informed me that service tax should not be collected on such flats. However, jaypee has collected service tax at the rate of 3.5% from all o[censored]s. 3.5% for a flat worth rs. 50 lakhs amounts to rs. 1.75 lakhs. We would certainly not get this back without a legal battle.

It would be better if more o[censored]s come together and contest the case as a group. I already have a few members in the group. We are planning to file two cases:
1. Compensation for delayed possession
2. Refund of the service tax wrongly collected

I have paid entry cost of above flat by Oct-2011 till date i have not got my flat as per agreement it was supposed to be delivery by jan-2015.

i am paying EMI to financing banker since Oct-2011.

This is Advocate Ira Gupta. The Jaypee has committed agaisnt many people and now intentionally the Jaypee is undergoing insolvency proceedings.
