Jinesh Shah — Fraud against Purchasing new Car

Subject: Illegal practice by Revealing incomplete and incorrect information to the customer about vehicle to achieve sales Target. Dear Sir, We had booked our BMW 5 series 520d Model on 12th December 2021, in Name Jinesh Kirtikumar Shah(Umbergaon-Gujarat), with Eminent Cars Pvt. Ltd. Surat, after conversation with their sales person Mr. Karan Melani. As per conversation with the sales person, manufacturing month of Car was supposed to be of September or October 2021, after such assurance we had issued a cheque of Rs. 2, 00, 000.00 as booking amount to Eminent Cars Pvt. Ltd. (Cheque No. 000121, Kotak Mahindra Bank, Umbergaon Branch). After this confirmation we had also given down payment of Rs. 19, 59, 000.00 to the dealer (cheque no. 000123, Kotak Mahindra Bank, Umbergaon Branch). We had processed Loan with State bank of India and after processing complete amount of the car was disbursed to the dealer on 31st Dec 2021.In the mean time we were constantly following up with the sales person Mr. Karan Melani .Tanveer Saiyed & Mr Mandar Tare(GM), over mail as well as whts app to give us complete detail of the vehicle since 20th December 2021; as we had to apply for insurance of the vehicle, But we were not given the information about the vehicle till 07th January 2022, To our surprise we came to know on 07th January 2022 that the vehicle was manufactured in Feb 2021 instead of Sep or Oct 2021.On questioning the dealer about giving such vital information after such a delay of 2 weeks; we were told that sales person would have done this to clear the targets. We are surprised that dealer can give such a casual answer and an internationally reputed company like BMW has given dealership to such people, they are trying to achieve their sales target by disguising the customer with false and incomplete information.We had told the dealer to cancel the transaction and give the entire money back, but instead he was offering us more discount on the same vehicle. But due to fraudulent practice we did not want to buy the vehicle from the dealer. So, the dealer was like we will have to pay 7% amount as penalty for cancellation of the transaction; But it is not fair on the companies part to charge us 7% penalty when mistake was completely on the part of the dealer; as they had not revealed the complete and the accurate information of the vehicle.We bought the vehicle for our convenience; instead we are facing a lot of harassment in travelling to our work place daily and have to incur the expenditure of Rs. 3000 to 4000 daily for travelling. Even our bank will start deducting EMI from 29th January 2022. So, just imagine as a customer we have to go through all this even after paying you entire amount of around Rs. 65 to Rs. 70 Lacs.So, we request you to look into the matter on priority and bring the closure by 28h January 2022, if the matter is not closed by this date we will be compelled to reveal the entire matter on various social media platforms like Facebook / Twitter Handle / Instagram & News Papers & in Media too and ask the people to never buy the cars from BMW, Eminent Cars Pvt.ltd.Surat, Where such type of fraud & Misguide taken in pratisce .If we do not receive our amount back by 28th January 2022 we will be compelled to charge to the company @ of 24% p.a on the amount we have paid to the company.
