Kanchangauri Co-op Housing Society — Opening of shop and Non-transfer of share certificate by the society.

Sir the matter pertains to the gross injustice made by society to the undersigned in respect of our flat. For your reference letters sent to society are enclosed herewith. Due to reasons not known, we have been facing unnecessary hurdles and unwarranted problems created by society in respect of flat. I feel that the things and the issues which can be sorted out by discussion and mutual understanding are being blown out of proportion by the society. I am narrating the complete detail below for your kind consideration and appropriate action at earliest.
My father Shri Vishnu Bhimaji Dhas (super senior citizen now aged - 82 Years) had purchased the flat in Kanchangauri Co-operative Housing Society Ltd. ( Reg. No. TNA/KLN/HSG/TC/886/86-87) situated at Phase-II, Building – B, Plot No. 13-14, Nana Shankar Sheth Road, Vishnu Nagar, Dombivli (West) - 421202 on 24.01.1996 and the same is registered with Sub-Registrar, Kalyan - 3 under entry No. 323 dated 24.01.1996.
The said society consist 2 wings, A and B and have common registration for both the wing. Only working committee is separate for each wing simply for the purpose of their routine work, of collecting maintenance/daily expenses. However, for taking major decisions in the society matter, there is a Core committee above the both the working committees, wherein 2 members of each wing are members.
In the year 2008, we had carried out repairing work of flat and we covered open area adjacent to our hall with the grill because our room was unsafe as the one beam of wall is attached to compound wall and at the other beam and compound wall there is hardly any space. So, we had to cover up the area with grill and we built one door at the compound wall for our personal use and one more side door as per instructions/guidance/request from society. In the year 2015, after informing society we had removed the door and window of wall facing road side and installed shutter for opening the medical shop. The only reason we did it was, some of the ground floor members of the A Wing made modifications in their flat and converted flat into the multiple shops which society has allowed. All the shops of A wing are running smoothly till date, moreover while converting their flats into shops they removed the entire front compound wall for easy access to customers. At present there is no compound wall in the A wing in front of their shops.
Initially some members of B wing, namely Shri Mahajan, Shri Paranjape and Shri Kadam didn’t take any objection and in fact Shri Mahajan suggested me to remove compound wall adjacent to our flat to get a better look of shop as per the situation permitted/approved and prevailed in A wing with the happy approval given to those shop owners. Thus, since there was nothing illegal or improper, we had removed the compound wall as per Shri Mahajan’s suggestion.
However, to our utter surprise and shock, after few months some disgruntled members of B wing namely Shri Gokhale, Shri Thatte, Shri Karandikar and Shri Mahajan himself took objection for removal of compound wall. Then after several meetings and correspondence and as per their letter dated 23.11.2015, we restored our structure as it was in the year 2008, and it is still there as it is for the last 12 years.
In the meanwhile, due to old age and natural love and affection, my father transferred the said flat in my name by making Gift Deed Agreement which is duly registered on 23.03.2021 with the Office of Sub-Registrar, Kalyan - 4. Vide letter dated 02.04.2021, I have handed over all the necessary documents namely the photostat copy of Gift Deed agreement, transfer set, original share certificate and paid Rs.600/- to the society.
Now, just to harass us and deny us our genuine rights, the Society has denied to transfer shares in my name on the above said flimsy grounds now without any valid ground insisting for erection of compound wall as it was before 2008.
Sir, kindly note that I am a retired & senior citizen. Since I am a registered pharmacist, I would like to open a new medical shop in our premises to serve the public in these pandemic time as well as earn some additional income to support my family.
Sir, I kindly request you to look into the matter and take appropriate action and instruct the society to allow me to open medical shop or any other shop and also direct society to handover share certificate to me immediately, as it is my genuine legal right and the matter is already four months delayed.
