1. A Society of any building collects thousands of rupees every month/ quarter from the residents of that building and consequently in return falls under legal obligation to provide all the services as laid down in the bye laws.

2. And therefore the relation between the society and the residents amount to that of a seller and buyer. Making them fall under The Consumer Protection Act, 1986.

3 And therefore if the society is found negligent and deficient in its duty to provide all the legal services to a resident, it could be dragged to the consumer court, for heavy compensation and penalty for all the monetary losses and severe trauma caused by the deficient and negligent attitude of the society. Consequently the resident could legally stop the payment to the society. No service, no payment-the principle of justice. And also, such chairman and the secretary have no right to remain in chair, but must resign to let the more responsible and concerned persons occupy these important posts to do their legal duty with accountable responsibility toward residents.

4. When any outsider applies to transfer a flat in that building to his name, it is the legal duty of the society especially the chairman and the secretary to look into the case thoroughly before sending consent to the applicant to transfer the flat.

5 In our case, when fraudulent people applied to the society to transfer my flat in their name through miss leading documents, and in spite of oir repeatedly pointing out about the property scam fraud, sent to them through speed post, they ignored all the serious legal notices very comfortably, pretending to be deaf and blind, obviously to favour the applicant against heavy bribe.

My grievance stands as follows.

1 MY REFERENCE
My two previous legal notices served upon you through speed post, regarding fraudulent advocate Ms Suman Jain for her illegal attempt to transfer our residential flat # 35, through fraudulent documents, with your illegal support against bride.

2. A substantial period elapsed but no response from you over such a serious issue. Why?

3. The period permitted by the Bombay High Court of 6 months to produce original Will expired but they failed to comply with the court order. Making the Probate, ineffective, null and void ab initio, leaving no right to you to transfer this flat.

4. Have you ever asked to the advocate for clarification over all the allegation we have made against the advocate in our previous two notices served upon you?

5. If not, why? It was your legal duty to ask for the clarification. Failure to ask, evidently amounts to illegal favour and support to the fraudulent advocate against bribe.

6 And if you have asked, have they ever replied? If so, submit the copy to us of all the correspondence between you and the advocate.

7. Make a legal note, this is the Bombay High Court matter, pertaining to properties scam, and your no action in the matter would go against you for supporting silently to all those criminals, involved to grab my residential flat through illegal means.
