[Resolved]  Makemycombo.com — Deficiency in Service & Compensation Demand

Dear Sir,

I, Rahul Ginodia, a registered user on MakeMyTrip App since many years, am your regular customer and have made of quite a lot of bookings for air tickets, hotel stays and airport cabs using your app. I am registered with the email address [protected]@yahoo.com and mobile number (+91) [protected].

On 12th December, 2021, I had booked a cab from Bengaluru International Airport to my home for pick up on 14th December, 2021 @ 10:15 P.M. bearing Booking ID NC[protected] as I was returning from Lucknow via Air Flight AI-566 which was scheduled to depart from Lucknow @ 07:15 P.M. and arrive in Bengaluru @ 09:45 P.M., which round trip flight booking was also made through your app by making payment of the full booking amount of R1, 009/- through my credit card. Upon landing in Bengaluru, I received a text message on my mobile from your system informing me about the cab & driver details. As soon as I collected my baggage, I tried reaching the driver of the cab assigned for my trip (Ashok G [protected]) many times but there was no response from him. Please note that this flight was booked to reach home in time well before midnight for my wedding anniversary which falls on 15th December and it was very discomforting to get stranded at the airport.

To raise a complaint about the same, I reached out to your customer care number and I was informed by your customer care executive that the said driver tried reaching my mobile around 08:36 P.M. which is just a lame excuse as your company and also the driver was very well aware that I would be in flight at that time with no access to network on my phone. This goes on to show the malafide practice and ill motives of your company to dupe its regular customers of the money paid by them and cause undue, unwarranted, and uncalled for harassment and mental agony to them by providing such deficient services. Till date I have not been provided with any resolution for this issue or for that matter at least the refund of money paid by me for the said cab booking.

It is pertinent to mention here that a similar issue had happened with me for the same services I had booked earlier (airport to city cab service) for travel on 5th September, 2021 from Bengaluru International Airport to my home, but no cab was provided to me and your customer care executive merely apologized for it and I was provided the difference of fare paid by me as compensation.

It is quite obvious from the turn of events that your company has clearly cheated me of the amount paid by me and have additionally caused much undue harassment, mental agony and gross discomfort by being acutely deficient in providing the services contracted for.

In the facts and circumstances aforesaid, I am issuing this demand notice upon you to refund the amount of R1009/- paid by me within 15 days from the date of receipt of this notice by you, together with interest @ 24% per annum from the date of booking, i.e. 12th December, 2021 till the date of payment and also a compensation of R5, 00, 000/- (Rupees Five Lakhs only) towards deficiency in services and causing harassment and mental agony to me, failing which I will be left with no other option other than to initiate appropriate legal actions against you, both civil and criminal, costs and consequences thereof only you will be held liable and responsible, which please note.

Kindly treat this notice under the provisions of the Interest Act, 1978 as well.
