Marconix Connect — They have cheated us by not doing anything on the assigned work and now they are not refunding vs advance amount Rs. 9000, paid to them

We had assigned them work for Banner design, Newsletter design, and Mailer design works. We had an agreement, where we had a deal of Rs. 12000/- per month and paid Rs. 9000/- as an advance in cash to Mr. Sanjay Kuma J N, Business Development Manager of Marconix Connect. Mr. Sanjay Kumar J N, was the person to sign the agreement on behalf of Marconix Connect. We assigned them work in June. The sample of work they started giving completely different from the ones they showed us at the time of Agreement. We were deeply unsatisfied by their work and gave them every details again and described every inch of what is desired. They said they understood and prepare them same. After that, they never turned up and we did a lot of follow-up and never got anything in terms of our work from them. Then we decided to end the contract and sent them mail regarding the same on July 6th and asked them to refund us the full amount, Rs. 9000/-, which was paid to them as an advance. He, Mr. Sanjay, never replied to our mail, but over the phone he confirmed that he has received the mail and requested for re-consideration. We said 'no' and he agreed to refund us our Rs. 9000/-. From that day to till date he is giving us lame excuses and not refunding us our Money. For last two days he is not even aking our calls. We sent him final reminder and said we will take legal action against him. But no response from him.
