Dear Sir, This is to bring to your notice that we the undersigned Flat Owners have booked flats in “OPULENCE” a project by MAULI LIPANE PROPERTIES. We have booked the flats almost about 3 years back, As per the agreed schedule of payment terms we have been paying our dues regularly on time. Due to some unavoidable circumstances few o[censored]s were unable to pay one odd payment slab on time he had to pay penalty as an interest on the outstanding amount dew. However, in spite of regular follow-up of our members regarding possession of our flats which we have booked in the said project we have not received any intimation from the Builder. This while booking the flats was confirmed as he will give the possession in about 2- 3 years down the line from the date of booking. We are still not getting any confirm date of possession from the Builder’s end. We have given certain commitments to our other surrounding people on the basis of the commitments given by the builder during booking of the flats. To our surprise we came across an advertisement published in daily News Paper “SAKAL” on Saturday, 27th September, 2014. The advertisement was launching of “OPULECNE PHASE – II” ‘B’ building and Opulence building ‘C’ for commercial purpose in the same premises that of “OPULENCE “ by the name of “OPULENCE PHASE – II” a project by LIPANE LANDMARKS. When we booked our flats in Opulence project they were never informed about any plans of Phase – II and that is why only we booked our flats according to size, light, air ventilation and view of our flats and these are their USP’s at the time of selling of their flats and we negotiated our flat value on same basis and now they want to start their second phase in the same project where they have promised us CLUB HOUSE, SWIMMING POOL, TODDLER POOL JOGGING TRACK, AMPHITHEATER, SENIOR CITIZENS PLAZA, WELL EQUIPPED GYM, MULTIPURPOSE COURT, CHIDREN’S PLAY AREA, COMMUNITY HALL WITH PARTY LAWN, UNDER GROUND WATER SUPPLY TANK . But as of now the builder has scrapped all the above mentioned amenities and squeezed them and shifted them to the front sized which was not there in the plan while we booked our flats. This type of attitude and behaviour from the builder end is not acceptable from our side at all… We hereby enclose their original project brochure and plan blue prints for your ready reference, which were used by builder side at time of sale. According to builder’s opinion they got additional FSI approval in last few days and that is why they were going to start another building in same opulence premises, which may attract additional load on the society for almost all the amenities provided by the builder in the future. So we all have objection on the same and we feel that builder is cheating us and we need your help in this regard. We are also recording our objection in the ‘Grahak Panchayat’ as well as 5 newspapers and 5 Television news channels. We will inform you this case as instructed by News media and ‘Grahak Panchayat’. As per of our agreement builder has to inform us before their decision on phase 2 and changes in the provided old plan to us at the time of selling flats, so we may request to you please do not approve and hold their any additional plan for phase 2…. We hereby also enclose a copy of the advertisement published in the newspaper as mentioned earlier and photo copies of the blue print layout which is provided by the builder at the time of sale of flats to us… We request you to kindly look into the matter and take appropriate action at the earliest. I am writing this communication in regards to the fraud builder Mr. Gopinath Lipane and his all partners and their construction company “Mauli lLipane Properties” and “Lipane Landmarks” who are published false advertisements in the various real estate websites (Links mentioned below for reference) and these websites also reviews and recommendations given on their website to this fraud builder Lipane which help him to cheat many innocent people which is not good.

I am one of the unfortunate flat owner who purchased flat in his ‘Opulence” project which is situated in Narhe-Pune in year 2012 and that was the biggest mistake of my life.

While purchasing this flat I have been told that there will be only one building in the entire premise and rest of the land will be used for Garden, Play Park, common amenities and parking. Also I have been told that once the required flats are sold, builder will form a Housing Society and hand over everything to Society. Considering the spacious amenity space as described in the brochure & the commitment about formation of Housing Society, I have decided to book a flat in this project however apparently our dreams turned in to nightmare.

Up on several requests over email, phone, SMS etc builder never responded to our request on Society Handover and all of nowhere one day we got a notice that there will be an ‘APPARTMENT’ formation instead of ‘Co.Op Housing Society’. Builder had plan to reduce/shrink the amenity space and build another tower without any prior discussions or consent from any of the flat owner which is completely against the law and the agreement that we signed.

We all flat owners came together and decided to fight against this injustice. After years of efforts and money spent on several official, courts and legal matters, last year we successfully managed to form a Cooperative Housing Society (deem society formation) by fighting against the builder Gopinath Lipane and his partners (Mauli Lipane Properties and Lipane Landmarks) in court. Even builder was making false complaint against our society members with the help of some police officers and he is trying to pressurise us with the help of sinhagad road police station but after so many efforts we file criminal complaint against builder under MOFA and and he was arrested by pune police on 8th August 2019 and he is on bail now.. However we still have several challenges and existing issues that we have to face on day to day life like –

1. All Court matters and legal issues we are facing at the moment.

2. No drinking water supply from local authority and bilder side.

3. Incomplete amenities like swimming pool, garbage treatment plant, garbage shoot etc.

4. Club house is too small to accommodate even one person per flat. Useless !

5. Extra small children play park

6. Parking allotment is pathetic and in illegal way.

For GOVERNMENT: Please help us in this regard its serious matter of 55 families
