Nellikal Motors-hero Motocorp — Complaint Regarding Financial Irregularities with Nellikal Motors-Hero MotoCorp

My name is Nijith.A residing in Calicut, Kerala and I am writing to bring to your attention a matter of serious concern regarding my recent financial dealings with Nellikkal Motors located in koottanad, palakkad, kerala and Sri Ram Finance located in Thrissur, Kerala. I believe that these companies have engaged in fraudulent and deceptive practices that have caused me financial harm.

I approached Nellikkal Motors in September 2022 to purchase a new bicycle. I was provided with a quote for 93K for the Splender motorcycle. Since I had a friend who is the son of the founder of Nellikkal motors-hero MotoCorp Mr Jithin NP, I decided to contact him in Thrissur from Kozhikode. Once I had agreed to the price and the onam offers provided, I paid a 33k deposit and a loan of 60k. A total of 23k was paid through UPI into Mr Jithin's account (Attachment 1), while the remaining 10k was given in hand when Mr Jithin arrived at my home in Calicut with the bike and necessary documents to be signed.

However, I did not receive the onam offer, I also neglected it, and the loan scheme explained by Mrs Remya from Sri Ram Finance working for Nellikkal Motors was 6731 rupees for 7 months and 5731 rupees for 4 months (attachment 2). We agreed to this scheme, and my father signed the documents provided by Mr Jithin on trust.

In our case, we did not receive any loan details from Sri Ram Finance, which is a serious mistake on their part.

In the 8th month, our account was debited 6731 rupees, so we contacted Mr Jithin regarding this and he told us there was no need to worry and that it would be automatically adjusted at the end. We again trusted him since he is a friend, but in the last month, September 2023, also Rs 6731 was deducted (attachment 3).

In response to my contact with Mr Jithin, he informed me that it was a Sri Ram Finance fault since he was out of the country. He instructed me to contact Sri Ram Finance directly. When I visited the Sri Ram office in Calicut, the staff was very courteous and explained all the details to me. When I realized that Nellikkal Motors had put a loan amount of 75k instead of 60k, I was shocked.

My concern was conveyed to Mr Jithin, he said it may have been a mistake from Mrs Remya, but she is no longer employed there. He has promised to resolve the matter and refund my money.

As a follow up to this, he was not attending my call or was not ready to respond to my message. However, upon repeated texts and phone calls, he informed me that Mrs. Remya would be calling me and provided the number of his manager who also said the same, but Mrs. Remya did not call.

As I was not willing to lose my hard-earned 15k rupees(75k-60k), I personally went to Thrissur to meet the founder of Nellikkal Motor Hero MotoCorp. I explained all the issues to him after a long drive and waiting. He said he would investigate the matter as his son handled the transaction. He will study this matter and will refund the amount if any errors were made. But like his son, he did not respond to messages so I called him and it didn't go well. He was rude and said he didn't sell me the vehicle it was his son did and the vehicle is not also sold through his dealership.

In order to clarify, I conducted small research and discovered that the vehicle dealer was listed as Kalyan Mobikes on the Parivahan website (Attachment 4). The way these guys manipulated this is still a mystery to me since I paid 23k directly to Mr Jithin.N.P (attachment 1), who is the son of the founder of Nellikkal Motors. The staff members, including Mrs Ramya, also claimed to represent Nellikkal Motors, and my bike itself has a sticker of Nellikkal motors (Attachment 5). In this whole issue, I am hearing about the Kalyan mobikes for the first time. This is an act of blatant fraud by Nellikkal Motors.

My mother contacted Sri Ramya from Sri Ram Finance after all this, and she informed her that the scheme had already been conveyed and signed. Our response was yes because the plan you informed us was 6731 rupees for a period of 7 months and 5731 rupees for a period of 4 months (attachment 2). However, this is not the way the money was deducted, but now she is claiming she didn't say that and the message was not sent by her. It's all fake. As all of the previous discussion she asked to visit Mr Siju Sunny (manager) at the Thrissur office as she completely withdrew from the issue. We contacted him just like others. He also said he would research the issue and call back, but did not.

As a result, I am left without a refund and do not know who I should ask for the money. Who changed the 60k loan amount to 75k Nellikkal Motors, Sri Ram Finance, Mrs Remya, or Kalyan Mobikes. This letter is intended to assist you in resolving the issue. It is my belief that these companies must jointly determine which one of these companies cheated me and caused me significant financial and mental hardship.

Moreover, I would appreciate it if you would investigate this matter and take appropriate action against Nellikkal Motors. I would also appreciate it if you could provide me with guidance on how I can recover my financial losses. Otherwise, I will be forced to take the matter to the police or to a court of consumer protection.
