Details of the Complaint
I wish to lodge a formal complaint against NoBroker and Tata Amantra Housing Society for misrepresentation of services, lack of transparency, and unfair trade practices, which caused me financial and decision-making disadvantage as a consumer.
While searching for a residential flat on rent through the NoBroker platform, multiple listings for flats in Tata Amantra, Kalyan West prominently displayed amenities such as swimming pool, gym, and clubhouse facilities. These facilities were shown as part of the society amenities and played a decisive role in my decision to shortlist the property and conduct a physical visit.
However, during the site visit, the flat owner informed me that:
The Tata Amantra Society has withdrawn free access to swimming pool, gym, and clubhouse for rented families.
Tenants are required to pay additional charges to use these common facilities.
These charges are imposed by the society and are over and above the agreed rent and maintenance.
This crucial information was not disclosed on the NoBroker listing or during the initial search process.
Grounds for Complaint
Misrepresentation of Services:
Amenities were advertised without disclosing that tenants must pay additional charges, which is misleading under consumer protection laws.
Unfair Trade Practice:
Displaying amenities as inclusive while later imposing extra charges amounts to unfair and deceptive practice.
Lack of Transparency:
The actual cost of living is higher than represented, as additional facility charges effectively increase the rent.
Discriminatory Practice by Society:
Charging tenants separately for common facilities that are part of the society infrastructure is unreasonable and creates unequal treatment between owners and tenants.
Deficiency in Service (NoBroker):
As a service provider, NoBroker failed to ensure accurate and complete disclosure of material information in property listings.
Relief Sought
I respectfully request the Hon’ble Consumer Forum to:
Direct NoBroker to ensure complete and transparent disclosure of amenity-related charges in rental listings.
Direct Tata Amantra Society/RWA to clearly publish and communicate its policy regarding tenant access to common amenities.
Take appropriate action against misleading listings and unfair practices.
Consider suitable compensation for inconvenience, time loss, and mental harassment caused due to misleading information.
