1. Date and time of Occurrence :[protected] at 10.00 a.m
2. Place of Occurrence: In the Office of the Complainant at Chandra Gandhi Nagar.
The Complainant begs to state as follows:-
1. I M.Selvaraj, the Complainant is the General Manager of Non Stop Courier and Cargo Pvt Ltd., Chandra Gandhi Nagar.
2. I state that, The Accused NOS 3 to 8 are also the franchisees of the same company. The complainant is the General Manager of the above said company. The Accused NOS 1 and 2 has published an article (page no. 26 – 28) in the title of
“ கோடிகளை சுருட்டிய கூரியர் கில்லாடி! நான்ஸ்டாப் சீட்டிங் வேட்டை ” . The Accused No.1 is the popular Editor and Publisher, and the Accused No.2 is the Reporter of “Nakheeran” Tamil Magazine, head office at Chennai.
3. I was shocked on seeing the magazine because whatever the allegation said by all the Accused are totally imaginary and need a strict proof of the same. because all the Accused NOS 3 to 8 (franchisees) are well aware of the contact details of the company officials and all the other franchisees are carrying out business (except the Accused) in a successful manner without any interruption. Even in the article, the address of the branch office is clearly mentioned.
4. I state that, as the business is carried out well, the averments contained in article are totally fake. The complainant is affected by the article that published in the Magazine. All the Accused are acted in an intension to bring a disrepute to the Company. The Company is unable to run business in the assigned location. Customers who comes to the office of complainant keep on asks about the article. In page no : 28 it is mentioned that Vasantham Media is also a forgery company, but it is not so. Because, the Vasantham Media is only an advertising agency, whereas no investment is needed.
5. I state that, All the Accused are in an intension to interrupt the business and incur irreparable loss to to the company and their staffs All the accused have executed this plan to explode the company. In page no : 28 it is mentioned about Black Romeo. whereas the same is still in the starting stage and in process only. No investments are made so far. All the Accused have created a mental agony to the total part and parcel of the company.
6. I state that, The Accused No.1 and 2, being in a loyal profession have acted against the Law. It is the duty of the Press to enquire the case and report the same. Also to act in the name of truth. but the Accused NOS 1 and 2 are failed in this case.
7. I state that, The Accused NOS 3 to 8 are legally thrown of the company for Misrepresentation and Breach of Contract. As there is no connection between the Company and the Accussed, no truth prevails in this matter.
8. I state that, The Accused NOS 1 to 8 has voluntarily caused damages and they are liable to be punished U/S 499 and 500 of Indian Penal Code.
9. Therefore, this Hon’ble Court may be pleased to take the complaint on file, cognizance of the offences, issue summons to the accused, punish the accused for the offences committed by them and thus render justice.
