I am the owner of Flat No. 1503, Tower 17, The Resort (Part B), New Chandigarh, developed by Omaxe Developers Limited.
I wish to bring to your notice that the construction quality of the above-mentioned flat is highly unsatisfactory and does not meet the standards that were promised by the builder at the time of sale. After taking possession, I observed several serious defects indicating poor workmanship and the use of substandard construction materials.
The deficiencies include, but are not limited to:
Poor quality construction resulting in visible defects in the flat.
Use of inferior construction materials, adversely affecting the durability and safety of the property.
Defective finishing work, including uneven walls, poor plastering, and inadequate paint quality.
Defects in flooring, doors, windows, fittings, and other fixtures.
Water seepage, leakage, dampness, and cracks (wherever applicable).
Failure to deliver the flat in the quality and specifications promised in the builder's brochures, advertisements, and agreement.
Deficiency in service and unfair trade practices by delivering a property that is not fit for the quality expected from a reputed developer.
Despite raising these concerns with the builder, the issues have either not been resolved or have been addressed in a superficial and temporary manner. The builder has failed to provide a permanent and satisfactory solution.
The acts of the builder amount to deficiency in service and unfair trade practices under the provisions of the Consumer Protection Act, 2019. As a consumer, I have suffered financial loss, mental agony, inconvenience, and harassment due to the poor construction quality and the builder's failure to rectify the defects.
I therefore respectfully pray that the Hon'ble Commission may kindly:
Direct Omaxe Developers Limited to rectify all structural and construction defects using quality materials through an independent expert agency at its own cost.
Award suitable compensation for mental harassment, inconvenience, and financial loss suffered.
Direct the builder to reimburse all expenses incurred or to be incurred in repairing the defects.
Award litigation costs and any other relief deemed fit and proper in the interest of justice.
I undertake to produce photographs, videos, correspondence with the builder, possession documents, sale agreement, inspection reports, and any other evidence in support of my complaint.
