Pacific Development Corp - Pacific Golf Estate — very poor quality construction & false commitments to deliver

Very poor construction defective design and weak strength of the a-block the entire building columns and beams have given way with cracks all along the building on the outer overhangs and corners of the building that can cause any mishap if the building settles any further or with the slightest or earthquake tremors experienced in the near future. Almost all the 1bhk studio apartments have huge cracks including flat no: a-201 owner by the complainant. Quality and correct ratio of cement has also not been used resulting in very poor bonding of bricks and wall plaster which has more of sand and hollow spaces in between as can be verified from the site block a of the pacific golf estate development, marotha, sahastradhara road, d. Dun. A huge beam runs almost in the centre of the master bedroom at a very low height disproportionate to the height of the roof and layout and gives a very congested cramp feeling where, the ceiling fan is placed almost to one side of the room and such is ineffective and faulty in design. Very poor quality and substandard grade of floor tiles, wooden fixtures, doors, electrical fixtures, and kitchen cabinets have been provided are nowhere close to what was shown at the time of booking as per sample flat created at the temporary site office. The builders had promised of wooden flooring in the master bedroom as per brochure (On record) and as per sample flat, however, nothing close to the assured/promised quality and design was delivered by them. Fans are of very inferior quality by the name of epson which appears more like a computer printer company name and only two were provided. Light fixtures and kitchen chimney are also sub-standard quality. Paint job is inferior and rough and all round finishing of the said property is very poor. All cp fittings and cabinet shutters were scratched in the process of cleaning them off paint stains and damaged beyond repair. The entire walls have seepage of water and the balcony design is such that rain water makes the verandah unfit for use during rains/monsoons.

The builders despite reminders for past two years (Via phone calls, sms, emails - secure with the complainant on record) has denied to furnish copies of the ownership title of the property along with the approved blueprints by mdda, the local authority for reasons best known to them. The completion certificate issued by mdda for block-a has also not been provided. The complainant had applied for a loan from axis bank two years back and the bank’s advocate wrote to the builder to furnish some ownership documents which were not submitted till date resulting in huge financial and interest loss to me. (The emails and letters are secure with me for reference and record) the loan was sanctioned by m/s axis bank, gms road, dehradun but could not be disbursed as the builder did not assist to enable me avail the housing loan.

The complainant again this month may 2018 requested the builder to furnish the documents pertaining to the said project, ownership and approved maps etc to avail a loan against property from m/s india bulls finance co. Ltd, dehradun, however, to my entire dismay they again refused to assist me or submit any document where the undersigned has already deposited the filing charges to the financers and the file is once again stuck for want of documents.

4. There are numerous complaints for deficiency in service and failing to deliver the right committed quality and services till date. The builder has defied the principle o[censored]tmost good faith and adopted all means of cheating the naïve home owners/buyers by putting forward tall claims in adverting the said estate which clearly is a violation of law and can also be termed as false and misguiding advertisement and attracts various other laws governed by the learned authority since it has come enforce. The safety parameters for the residents with regard to the unsafe building and huge cracks that have developed are a serious concern for a multi storied buildings constructed in this high e. Q seismic zone of the north.

5. The complainant most humbly requests to appoint a commissioner /as deemed fit to look into the facts above in the interest and safety of the home owners and take appropriate action against the builder for such unlawful acts and omissions. A detailed report be sought for the ownership title, land conversion of the entire property estate with sanctioned maps and its verification-survey at the site to confirm any anomalies.

6. The complainant had to go through a lot of pressure from the banks, advocates, registrar office, mdda office, office of the builder from pillar to post for two years to enable me resolve the issues, however, after all the efforts failed the undersigned was left with no recourse but to file a complaint with the competent authority to take appropriate action and do justice to the home owners.
