1. That the Complainant is the registered owner of a Hyundai [Model Name, e.g. Creta / Venue / i20] bearing registration number KL 39 D 2222 serviced on[protected] at the above service centre.
2. That on the service date, the Complainant entrusted the said vehicle to the Opposite Party’s authorised Hyundai service centre for steering repair. The vehicle was received under Job Invoice No. B[protected].
3. That at the time of delivery, the Complainant noticed visible damage to the vehicle’s interior right panel of dashboard, and that the airbag compartment had been tampered with / dismounted, which was not present before service.
4. That the Opposite Party’s staff initially accepted to messages and photos, but initially enquired about the issue. They had admitted that the dashboard panel was removed for inspection and ask to return car in owners risk to inspect.
5. That the said act of negligence and denial clearly amounts to deficiency in service under Section 2(11) and unfair trade practice under Section 2(47) of the Consumer Protection Act, 2019, since the consumer’s property was damaged during a paid service entrusted to the Opposite Party.
6. That the Complainant incurred additional expenses of ₹[55, 000] as per my independent assessment / repair estimate and suffered mental agony, inconvenience, and financial loss due to the Opposite Party’s careless conduct.
7. That the cause of action arose on [[protected] when the Opposite Party returned the car in a damaged condition and continues thereafter.
8. That this Hon’ble Commission has territorial jurisdiction as the Opposite Party’s service centre is located in Ernakulam District and the transaction occurred therein.
