Wake up prem court members you are being robbed of huge funds by management of society.
Dear prem court residents,
We 30 alert building resident members are informing you with profound grief that, we all residents of this building are being looted by the present committee since the time they have come into power, by huge funds belonging to all o[censored]s and most of the building members are still sleeping on this burning issue which has brought the soceity to the verge of bankruptcy, and handful of committee members are taking the entire society for granted.
It is not too late still that we all should remain alert now onwards, to safeguard our individual and joint interests from getting violated. Please go through the below issues carefully; to understand what is going on the prem court society presently, and now on please stay in the building with your minds, eyes and ears open.
Issues in a nutshell that have resulted in making frauds worth crores are as enumerated hereunder.
• the society has 16 garages most of them being converted to shops doing commercial activities, these garage occupants earlier were tenants of the prem court society. The outstanding receivable from these garage occupants in 2002-03, was around rs. 80 lakhs. The committee made a settlement of the outstanding amount with the garage occupants by accepting rs. 35 lakhs in full settlement of dues of 80 lakhs. They have wiped off the entire 80 lakhs and interest thereon from the accounting records, and for this the society has not passed any special resoultion seeling 3/4th majority building members permission. There are no details provided of the 35 lakhs being spent invested or misappropriated. 45 lakhs loss is borneby the society members and 35 lakhs no details which means an entire loss of 80 lakhs to all building members. We should ask for explanation to this from the committee or not please tell, or keeping silent will help gettting funds?
• the compound of the society was repaired in 2016-17 period. Please note that the quality of the work done is pathetic and the problem of the waterlogging did not get resolved. Please note that during the elections of the bmc it was made to believe that the entire compound work the society was done on the initiative and expense by lodha foundation, a note to this was also affixed outside lift on ground floor. Later the society shows an expense of over rupees 6 lakhs as its expenditure over compound repair work. On inquiry on the details of the expenses paid it was informed that the 50% expense of this compound work is borne by society and balance by lodha foundation. But the soceity says in writing that the computer being non functional no details of the expenses can be provided. It is hard to believe that the hard copies of the bills and vouchers are completely missing from society records. Now please tell is asking an explanation to this from committee a crime or a very necessary step?
• the society compound had glazed paver blocks in red and yellow colors fixed prior to repairs to the compound. These fresh new glazed tiles are worth rs. 100 + now if you go to purchase them new. These tiles are easly resellable in the market at duncan road for a reselling 2nd hand rate of rs. 38/- per tile. Please note that the total compound had several thousands of tiles fixed. None of these was broken, each and every tile was carefully removed and stacked in compound, and was removed in late night and early morning hours from society by truck lorries. These tiles are never dumped in sea for reclamation and on inquiry from contractor doing work even they have not taken the tiles of the society compound. Now for thousands of tiles removed each sold in 2nd hand price of rs. 38/- each please calculate the amount that the society must have fetched has the funds collected fom sale of these tiles been deposited in society accounts. No such money is deposited in society and the tiles are gone. Even the tile removal charges of the trucks and lorries is paid by prem court society. Now please tell arent you looted with this money, is it not necessary that the society gives the account of this money?
• flat no. 18 on 2nd floor was occuppied by tenant mr. Sugandh for several years the actual owner of this flat is not traceable and the society had an outstanding of around rs. 26 lakhs in year 2010, the tenant did not make any payment to the society, till he was one day found dead in flat no. 18 under mysterious circumstances. Presently the society in balance sheet of 2016-17 shows an outstanding of around rs. 32 lakhs only after more then 7 years. How is this possible if the society is charging interest of 21% per annum on outstanding amounts then how come 26 lakhs in such a long period becomes 32 lakhs even after no payment is received. The outstanding amount should be much much more. There is one more thing that after the death of the defaulter tenant the society should put a lock of the society on the flat no. 18 and start the proceeding of auctioning this flat under procudres laid as per section 101. The society even after this has not done this activity and on the contrary has allowed the long divorced wife of mr. Sugandh stay in the flat no. 18, which is totally wrong. The intention for not selling this flat under auction seems bad to grab the flat at throw away price. If the auction is done than as per auction and market ready reckoner price this flat can fetch over rs. 3 crores in auction which can go in society kitty and can utilized for building member benefit. Don’t you think that if the society gets more then 3 crores from auction there will be enough money with society to do important building works that can reduce member’s contribution burden considerably, think?
• flat no. 23 occupied by ajay dogra belongs to mrs. Raj h. Wasvani, who is made to belive that is not alive now. But the truth is that the actual owner lady is still alive and staying in koregaon near pune in a very pitiful handicapped condition. The prem court society is not sending any maintenance bill of this flat no. 23 to the actual owner since many years, as informed by mrs. Raj wasvani herself. The flat no. 23 had outstandings since long, but since past few years the outstanding dues are getting cleared against this flat from the society records. From inquiry made the treasurer says that they get the money against this flat from an undisclosed source which they write off against this flat no. 23. Inquiry ws made to share the details of the payments received and deposited in bank account of prem court society to know what is the actual position and truth behind this matter. But the society is not responding to this. Mrs. Wasvani is very tensed about this matter, she told that she was assured by chairman and secretary that they will let her stay in flat no. 23 and remove the tenant mr. Dogra, but on the contrary they have done nothing to help her and had appointed dogra as society manager. This issue seriously needs a review or not please give your views?
• you must all have noticed one fact that the society notice board in and outside the lift had a list of outstanding and defaulters affixed showing amounts due from respective flat owners. Now since many years no such list is put on the society notice board. No one is bothered to even inquire about the details of the outstandings that the society has to receive. Taking an advantage of this it has come to notice that few flats have got their outstandings wiped off and the society members are suffering a loss of the funds. Don’t you think it is very essential that the list of outstandings is a must to be kept affixed and modified regularly so that right picture is formed and no one can take any disadvantage?
• it is a well established fact now for all building members that the society committee is always making major manipulations in the final accounts of the society that they submit to the income tax department. The auditors are appointed and changed without prior permission and proper resolution passed in the agm with building member’s consent. The auditors are only concerned with their remuneration that the society gives and always don’t bother to go and check the accounts in depth to search for manipulations made in accounts by committee. It is these manipulations that keep getting carried forward for years and that become a ghotala, which once if gets exposed no one is having any knowledge of. The c. A and auditors only look into the balance sheet final total figure tally and just blindly sign and affix their stamps and seals to validate the erroneous accounts. No one in the building ever looks into the balance sheets and income and expenditure statements carefully and sends their queries to committee for rectification the result errors are never rectified. Don’t you think that if we carefully check the financial statements we can to some extent stop the frauds to happen in the society?
• we all are paying for the cc tv camera system rs. 1000/- per annum per flat which amounts to rs. 66000/- per year. Yet the worst cctv camera is installed in the society. Most building flats are not covered at all, yet has anyone ever asked as to what is the actual cost of the cameras and the cctv system and how much have we all have paid for it till now. Have you ever agitated for this no, but think that we all are loosing money without getting any positive advantage. No one has ever bothered to ask is the money so collected towards cctv camera charges ever paid to the party concerned of the contract. If yes then why the hell are we not getting proper service, think about this this is an important issue.
• we are keeping the biggest matter of fraud for your perusal in the end. The prem court society in the year 2012 on 12th october had auctioned two garages no. 8 and no. 13 to shri arvind shah and smt. Radhika rani gupta, for a price of rs. 41 lakhs and rs. 33 lakhs respectively. As per the terms of the auction the entire payment towards the purchase price of the garages worth rs. 74 lakhs was to be paid by either cheque or demand draft, that too within one month of the date of auction (I. E. By 12th november 2012) failing which the auction sale of the property will be deemed to be null and void and sale of the garage will be assumed as cancelled. The society records of financial accounts are not reflecting this entire amount of rs. 74 lakhs received till date. However it is pertinent to note that the society has not incurred any major expenses so far that made it spend such a big sum of money. The society accounts that show fdrs worth over one crore rupees are actually the fdrs that are going on and on since many years which are made and renewed out of the reserve funds that the society has and cannot spend money out of such reserve fund except for certain earmarked purposes. So please do not confuse your selves with the rs. One crore plus worth fdr that is reflected in financial accounts. The amount of rs. 33 lakhs deposited against purchase of garage no. 13 is received in the society bank account within one month of the sale of the garages under auction, bank statement from the drawee bank shows the same. However it is important to note that the society on inquiry of the said rs. 41 lakhs received from arvind shah against purchase of garage no. 8 it shows a statement that depicts that the payment of the dd of rs. 30 lakhs paid on 1st november 2012 and rs.11 lakhs is received after two months from auction of garage no. 8 thereby violating the terms of the auction to make the payment within one month of the auction sale date, thus the sale of garage no. 8 to arvind shah is null and void and sale agreement stands cancelled. Further more there is a doubt that this entire 41 lakhs is not received by the prem court society. The sale of garage no. 8 was not registered with the old custom house for a very long period and since the date of the auction that is 12th october 2012 the garage no. 8 is used and occupied by arvind shah, therefore the building members believe that the price of the garage is paid. The society is not providing a bank statement of the prem court society bank account for the periods demanded in writing where we can cross check the receipt of rs. 41 lakhs in society kitty. Please note that till the time the garage no. 8 was not transferred in the name of the purchaser how has the society allowed them to use this garage. What about bills raised for the maintenance charges and noc and electricity bills raised for this garage in the period in which the garage was not transferred. Has the society raised the bill or not, has it collected the noc charges or not, is the electric bill received in name of prem court society or in name of arvind shah is a matter that also needs to be inquired about. This matter is very important and a probe of the facts related to this issue are a must.
