Puthedan Holidays — refund of cancelled travel itinerary

1. My name is Col KE Patankar(Retd) and I am an armed forces veteran as well as a senior citizen who is residing in New Delhi . I wish to highlight an incident of duping and fraud by an individual Mr. Binu James and the company ‘The Puthedan Holidays’ based in Bangalore operating travel service in Kerala and request that an FIR be lodged based on the undermentioned complaint.
2. During the month of August 2017, I decided to plan a holiday to Kerala with my wife in month of December 2017.Accordingly, I went on the internet and searched for possible travel companies to help me with my itinerary .On the Kerala Tourism website I came across a travel company with name ‘Puthedan Holidays and Resorts Pvt Ltd’ alongwith contact numbers [protected], [protected]; [protected], [protected] .
3. I called the numbers and was spoken to by Mr Binu. Mr Binu agreed to undertake my Kerala trip hotel bookings alongwith taxi services from 30 December 2017 to 06 Jan 2018. The deal was struck for Rs 45, 000/- and confirmation received from Mr Binu James via e mail correspondence which is attached as Exhibit A.The person requested me to pay an advance of Rs 20, 000/- which I paid and was also forwarded a receipt of ‘the Puthedan Holidays’. The same is attached as Exhibit B. The money was paid into the following account:-
HDFC Bank A/C No [protected] on 17th August, 2017. A copy of the bank deposit slip is attached as Exhibit B.
4. I was regularly in touch on telephone/ mobile with Mr Binu and he assured me best services. He also forwarded me the travel itinerary which is attached as Exhibit C. The address of the travel agency in Bangalore is as under:-

5. During the month of November 2017, Mr Binu called and requested for balance amount of Rs 25, 000/- be paid to finalise the bookings. Accordingly I forwarded Rs 25, 000/- into the same account number and a receipt for the same was sent to me by Mr Binu. The receipt and the copy of the bank deposit slip, paid on 13th November 2017, is attached as Exhibit D.
6. I travelled to Mumbai from Delhi and had planned my trip from Mumbai. On 29 Dec 2017( one day before my flight to Kerala) at approximately 1030hrs, I received a call from Mr Binu stating that the company has some internal issues and our trip could not be undertaken by them. He requested to cancel my programme. I immediately cancelled my flight tickets and also requested him for refund of my amount which he agreed to undertake in 48 hours.
7. Since that day Mr Binu is being contacted everyday as well as the “thePuthedan Holidays ’ office in Bangalore has been visited. However the individual is not attending calls as well as not responding to messages and e mails .I also sent a recent e mail (copy enclosed as Exhibit E) which has not been replied to.
I request for a full refund of my money spent
