1. I am the original allottee o[censored]nit 302, B-6, Savana, Sec 88, Greater Faridabad, Haryana since 18 Aug 06, appx 8 yrs from now. Your all payments till date were made on time as per your prescribed schedule.
2. Recently, again I have received your letter dt 25 Jun 14 asking for final payment. Congratulations on offering possessions. I appraised them of the following issues which the coy had been avoiding since last 8 yrs :-
(a) Their project was found to be under tremendous delay of appx 5 yrs ( Minus 6 months) for which they are required to compensate @ 5/-psf per month for enhanced area of 1339 sq ft as per penalty clause of agreement mutually signed by both o[censored]s. The penalty amount will be appx @ 6695 X 54 = Rs 3, 61, 530/-
(b) Even as per consumer court latest directive issued in year 2013, the builder is bound to pay and adjust the abovementioned amount which needs to be credited in final payment plan due delay in project by the builder.
3. Refer your para 3 of terms & conditions of abid letter, which is totally incorrect . Penalty amount has to be adjusted in stages or in the final payment plan and not begged from coy as Theyare not paying any interest on delay penalty. Was this information helpful? |
