I am a member of defence Force who purchased a unit No 302 in T-6 SAVANA, in greater Faridabad project in year Dec 2005 from RPS builder for which he has offered possession on 25 Jul 2014.

2. But the builder has neither attended nor resolved the issues leading to denial of justice under right to information Act 2005 and consumer protection Act 1986.

3. The builder has charged an enhanced EDC of Rs 1, 41, 910 wef 10 Sep 2011, whereas the case is still pending in the Punjab and Haryana High court. He has compelled me to pay the amount against 24% interest with threat and time constraints.

4. During last payment I had asked to forward a consolidated payment plan with the penalty amount as his right to information. But he neither refunded the penalty amount nor adjusted or apprised the buyer how he would like to do it, leading to a situation where customer is kept in dark in spite of repeated reminders. We have clearly brought out that the penalty amount is far exceeding the instalment due and the payment has to be made vice versa, by the builder.

5. Rather than solving the issue, his office had has denied delay penalty amount of last 5 yrs to me as a buyer. As per mutual agreement, there is no such clause specified in clear terms. So there is no reason to hold penalty of the buyer.

6. It is again requested to guide RPS builder to follow guidelines and not to resort to fraudulent means to extract money from buyers or else I would be forced to take up the matter to consumer court.

7. A poor show by builder. Not recommended for dealings
