Ruparel Realty Developers — Non possession and bounce of refund cheque - Ruparel Orion

We had booked a flat with Ruparel group /K.D. Lite Developers in March 2021 with a commitment to get the possession in the month of December 2021.

Name of the Building - Ruparel Orion
Wing - "C" wing
Flat Booking date - 22nd Mar 2021
Registration & Stamp Duty Payment Date - 30th Mar 2021
Initial Possession date - 31st Dec, 2021

We had purchased a flat in Ruparel Orion at Chembur dated 22nd March'21.. 10% Registration amount Rs.20, 64, 920.00 has been paid initially along with Stamp Duty + Registration + TDS amount on or before 31st Mar, 2021.

Developer/ Sales officer of Ruperal had committed that the possession of the flat would be given by December'21, which was the only reason we had agreed to purchase this flat as we looking out for a ready to move/early possession flat.

Since March 2021 till date no construction work for "C- wing "has been started ! The land is in the same position as we saw in March 2021 (almost 3 years back).
Hence, we have requested/proposed the builder to cancel the agreement / deal for flat booking of "C" wing and we have asked him for refund of 10% + TDS amount i.e. Rs. 20, 64, 920.00 plus TDS of Rs. 1, 56, 040 which was paid to the builder.

We have met the developer officials several times and they always kept on giving us excuses and future possession dates, finally they had agreed to refund the booking amount in 4 installments via post dated cheques.

We have signed the cancellation Deed ( but not registered) and we were forced to sign a special POA giving authority to Mr. Sameer Khare to register the cancellation deed once all the cheques are cleared. They have handed over 5 post dated cheques which are now bounced due to ‘Insufficient Funds’. And reason given by the officials is that the bank accounts of Ruparel group are ‘FROZEN’.

How does government allow or sanction give permission for developing new projects if the older once are not completed/on halt..???? And RERA or government is not taking any action for this???

Ruparel realty developer is a very big cheater
