San Diego attorney Scott McMillan, The McMillan Law Firm La Mesa, California lost three lawsuits to remove a report naming him as a suspect in child molestation. A longtime friend of Scott McMillan, was arrested for child molestation. The report was filed as an exhibit in San Diego Superior Court Case No.[protected].

In fact, years after Kenneth Bourke’s arrest for child molestation, Scott McMillan had no issue with representing him in Bourke v. Castanda, 4th DCA, Case No. D024992 where the child molester requested attorney fees for him:

“Plaintiff requests reversal of Anti-Strike Ruling, and denial of Defendant’s unjustified attorney fee award of $19, 500. (It includes inflated “training costs” for unlicensed new interns, which judge was no discretion to award) and requests order for reimbursement of costs plus attorney fees for legal support assistance from associated supporting legal counsel Attorney Shaun McMillan, Esq., Attorney Scott McMillan, Esq. Attorney Jim McMillan, Esq, $10, 000 each, to McMillan Law LLP for legal assistance, counsel and services...”

Not long after this case, Scott McMillan La Mesa Attorney was forced to shut down his law school he operated out of his one man office. The State Bar of California said the McMillan Academy of Law, "is noncompliant as to three material requirements: Its law library is noncompliant since its hardcopy legal authorities have not been updated since 2013; without any tuition income, the law school’s current and future financial viability appears questionable; and its website and written materials offer outdated and misleading information to both the general public and potential applicants."

I hope this serves as a warning to people who intend to hire an attorney. Scrutinize the background of the attorney. Potential jurors may Google your attorney and find conduct like this and not look upon your case favorably. Although a juror is not supposed to look at information outside of a trial, the fact remains everyone has a phone and can Google anything to answer a question.
