Shubh Nivesh — Constructing house in basement and using for commercial purpose

I would like to know if it is legal to build a house in the basement and then use it for commercial purpose (Eg: for kidzee school).

It is a residential area were it is constructed. What are the possibilities under which a construction can be done and used for commercial purpose??
