[Resolved]  Sowparnika Projects & Infrastructure — Fraud -amount not refunded, documentation improper,unethical behaviuor....

Unfortunately, the work has been unsatisfactory because of following major issues

· Main door replacement or repair as its shaking. This problem has been informed In August 2014 & again to Mr Jagadeesh in person 4-5 times from October 2014 as per instruction from Mr.Shiva kumar, but still it’s the same. Also the polishing is not done on repeated requests too.

· All the ventilators (Kitchen, bathrooms) glass fixing is not done properly & in some of the places glass is missing.

· The plumbing outlets (Jalari) are not fixed and attended to.

· In bedroom No.2, i.e. next to kitchen as per our modification a/c point was asked but a/c point is missing. To top it, the flat has been inspected and given to us and billed for the same. You have charged Rs5500/-. Still today amount has not refunded. This I spending since 5 yrs. When buyers make payment 1-month delay also you will charge but you will either wont complete the work properly nor make payment properly. Now this payment is delayed by 5 yrs. Who is responsible.

· All 3 bedrooms, too much of seepages including in the walls.

· Master bedroom balcony door broken/damaged before occupation, repeatedly complained about it Mr Jagadish, got replaced but unfinished till date.

· Outside wall of our master bedroom is fully cracked which as per Mr. Jagadish in October 2014 told it will be rectified by doing breaking again from outside & plastering in 15days as labours are on holiday for Diwali. After this nobody turned up till date.

· Solar water not available.

· Main balcony outlet is not finished properly. Repeatedly complained about it Mr. Jagadish and still no result.

· Possession Certificate & CR not yet issued.

· Remaining 2 Master Keys not yet handed over to us till date

· 1 Main French door uninstalled due to alteration not yet handed over to us.

· All these above mentioned issues are pending from July 2014 & after we shifted in October 2014 repeatedly informed Mr Jagadeesh in person several times as Mr. Shiva kumar told that Mr. Jagadish is person in charge.

· But ironically for everything Mr. Jagadish replied that Mr. Shiva kumar has to tell only after that he will execute.

· Still all these problems are unattended. And there is no point of writing it at the complaint book coz all of it is just a waste of time.

· I have attached the file in the name 16th May 2015, written to Ramesh Babu after tele conversation of the same.

In the above issues, I do agree some of the issues won’t be in your scope. Infact most of the civil related issues are taken care by me such as:

1. Main door repair

2. All the ventilators (Kitchen, bathrooms) glass fixing

3. The plumbing outlets (Jalari) are fixing

4. All 3 bedrooms, seepages issues including in the walls.

5. Master bedroom balcony door replaced & finished.

6. Outside wall of our master bedroom is fully cracked, got it plastered, epoxy, painting etc.

7. Main balcony outlet is got it finished properly

But atleast the issues which are in your scope & very critical can be resolved such as:

· Possession Certificate & Completion Report not yet issued.

· Remaining 2 Master Keys of the house & rooms not yet handed over to us till date

· 1 Main French door uninstalled due to alteration not yet handed over to us.

· Along with AC point modification cost refund initiation.

You can verify all these above pending handover things at your end from your office records also.Hello Mr. Ramji,
I hope all is well & safe at your end.
This is regarding my mail related to Sowparnika Royal Splendor – Flat No. TC-04. The initial mail was address to yourself on Feb 5th, 2020. Since then you are looped in all the communication till May 21st, 2020. But did not get any response from your end.

As a matter of fact, I thought of going ahead with courteously to settle the at least few of the major issues, which I had mentioned in my first mail. But I don’t see any pragmatic attitude from your end.
But at the minimum the issues which are in your scope & very critical can be resolved such as:
· Possession Certificate & Completion Report not yet issued. – PC pending
· Remaining 2 Master Keys of the house & rooms not yet handed over to us till date
· 1 Main French door uninstalled due to alteration not yet handed over to us. - Pending
· Along with AC point modification cost refund initiation. - Pending

Now as per 21st May 2020 mail from your associate Mr. Lokesh, says no settlement can be done for any of the pending issues due to your account closure, which is enforcing me to proceed with legal action.

But before that thought of discussing/conference with you once.

• Firstly, wanted to know on what basis/ground you have confirmed that accounts have closed hence cannot refund / settle the pending issues?
• When your accounts are not tallied how can you close the accounts, if still you did then its manipulated.
• When you have some outstanding amount from the customer, even though accounts are closed you don’t deny the payment from customer.
• When association’s & some of the resident’s individual case is running still, how can u say accounts are closed. This shows sheer deceiving.
• Give me in writing that, due to accounts closure, insufficient funds in the account you are unable to settle the pending issues.
• For registration, you don’t accept even one rupee less to your valuation nor for the extra fittings. In that case why we must accept when we made full payment as per your quotation without single paisa negotiation but still not completed the work properly beside the delayed delivery of the possession several malpractices, deficiency in service, quality, improper amenities.
• Let me clarify you one more thing, as per you the settlement amount would be less for you but not for me & even if it is less also, i would prefer to make that donation to a beggar but not interested to make any sort of donation to such fraudulent.
With all these it clearly shows your commitment towards customers are unethical, corrupt, unscrupulous attitude.
I am waiting for your finally response within 5 working days. Lack of responses within the stipulated time, will be advancing with legal action on the 6th working day.

After wirting n no. of time to MD Mr Ramji, still not even single response from the SO CALLED MD. They big fraud. I can say they are doing dignified begging just saying accounts are closed. CHEAP BEGGARS. DONT EVER DO MISTAKE OF BUYING FROM THESE BUILDERS. NONE OF THE PROJECT IN MYSORE IS PROPER.SO MANY CASES ARE FILED AGAINST THIS BUILDER
