Based in Bangalore, looking to purchase a small Apartment for myself. In July 2024, in response to a Housing.com posting for Sale of 2 BHK in the Apartment complex Sterling Apartments Madya in Surathkal I contacted the owner/ proprietor Mr. Shetty, who indicated that freehold Flats are available for Sale. I then visited this site on 24th July, 2024.
The owner showed me the apartment I was interested in, I decided to buy, and he apprised me of the purchase process. I was told that after I have paid the Booking deposit, full Registration of the Flat can be done at some time in July or August (on my next visit).
I decided to buy the place, and in response to his demand, made him a check of Rs. 1 lakh. We agreed that on my next visit in August, I will pay the remaining balance of Rs. 28.5 lakhs, and registration can be done same day.
Owner gave me two receipts for the Booking deposit. After I returned home I kept on asking him about finalizing the Registration Date, but it appears they cannot do the registration, maybe there is some land problem, etc. they did not reveal.
They are not able to give an official Registration date/ time, challan, etc. they way it is done usually, Mr. Shetty is acting vague and evasive. He mentioned I can "come next week" for registration, but did not mentioned any exact date, nor sending the official Registration paperwork that is usually sent before calling the buyer for registration. I suspected later that maybe he is not even in a position to properly register the Flats for some reason.
I finally got tired of this waiting game, and requested him to return my deposit of 1 lakh, in writing (this was sent to him by email and by letter courier). He is refusing to return my deposit.
I am a single working professional, and cannot afford to forgo this 1 lakh deposit. Have attached the two deposit receipts FYI. Can something be done to convince the owner to refund my deposit?
