Sudarshan Estcon Private Limited — Non refund of advance amount.

Updated by khirod 58 I had booked flat no 631 Block B Bimla Nivas Sudarshan Vatika situated at Mendhasala Haripur Khurda in September 2012 by giving an advance of Rs.805000.00 to the builder MS Sudarshan Estcon Pvt. Ltd. Plot No.700 Sahid Nagar Bhubaneswar 751 007. In the month of Dec.2012 SBI from where home loan was sanctioned disbursed Rs.163000.00. After waiting for 2 Yrs and 08 months no progress in construction noticed. I sent a letter to builder on 10th June 2015 to cancel the dealing of booking and refund the money with interest as violation of agreement was done by him. On 30th June 2015 booking was cancelled. The builder did not agree to pay any interest and make onetime payment. He handed over 12 no. post dated cheques for the total amount of Rs.928518.00 after deducting service tax of Rs.39482.00 which were due in the months of August October November and December 2015 as per his own convenience ignoring my problems with no payment during the months of July and September . In August 03 cheques were due on 08th 18th and 29th respectively amounting Rs 231000.00. Rs.77000.00 each. The builder did not wanted to give money on due dates rather requested to transfer money to my Savings Account in small installment. After several requests of time extension by the builder and cheating by narrating different stories Rs.171000.00 transferred in 06 installments till 22th September starting from 18th August. Seeing such type of attitude third cheque for the month of August 2015 due on 29th made bounced on 25th September. Same evening Rs.30000.00 was transferred to my Account requesting to transfer the balance Rs.30000.00 by 29th September. Now not responding to transfer the above said balance amount and every day different story are told. Next cheque is due on 10th October 2015 for Rs.77000.00. In the month of October total due is Rs.231000.00 in 03 cheques. Please do the needful for payment of all the remaining 09 cheques on scheduled payment date as well as balance Rs.30000.00.
The builder kept my money from September 2012 and no construction was made. It is immense financial loss to me as the money was blocked and now where I booked a new flat the rate was much higher. Neither the builder gave any interest or paying money as per commitment. I am just begging and running after him for my due. I am being harassed and cheated by the Managing Director Mr. Pramod Behera and Official Mr.Amulya Kumar Mohapatra.
The builder should also pay the bank interest as he could not deliver the flat as per agreement and kept the above amount blocked for a period of nearly three years in addition to timely payment of the cheques given.
