Sumaiya Parvin — Discrepancy in Plan & Occupancy Not provided by Builder since last 8 years

I had purchase 1 bhk flat in Vashi New Mumbai on Home Loan basis around March 2013, at the time of purchase the status of construction was 90% work done, touch up was pending, so Occupancy wasn't available at this stage, builder said, it would be available soon and within a month I was provided with the keys after payment without Occupancy Certificate. Whenever I asked for OC he said it is in process. Recently I eagerly wanted to sale flat and I inquired with the concerned department to know why it's been delayed. I was shocked to know going through the complete plan that builder has sold me the part of one single flat, and my neighbor's flat he has done gift deed. My flat being part of one single flat and other part belongs to other person. We both are cheated by this builder. We are stucked, we don't have regularised plan and don't have OC, if he has done this he must have get the plan regularised before any transaction. Inspite of several reminders he is just giving me the promises and dates so far.
