My name is Biju Kuttappan and I took Ace mega XL model vehicle on finance from tata motors Thiruvananthapuram branch on 21st July 2018. Loan number ([protected]).I was paying EMI of Rs.10000 per month due to the covid problem and at that time moratoriam benefit was not given and I was told that 4 EMIs were pending and the loan was forcibly reversed and the EMI was converted from Rs.10000 to Rs.16000. Due to the covid crisis, when the works decreased, I was unable to pay this amount. As a result, EMI Dues came up and despite several requests to reduce the EMI payment, no positive action was taken. Called from the branch in the month of November 2022 and Rs.185000 The final settlement was given and there was an instruction to pay this amount within four months and close the loan 15000 was paid on the same day.Then on February 24, 2023, Rs. 100, 000 was paid. I received a text message from tata finance on my mobile saying I have to pay Rs 127004. After two weekup, Arun Chandran, an executive at Tata Motors Finance, contacted me and said that there is a loan pending and I have to pay Rs 142000 including overdue. As I do not have the money to pay that amount together, I inquired with Arun Chandran, the executive, whether it is possible to make the EMI less than ten thousand rupees. According to that, there is a firm called Shakti Finance and they will settle the current loan to Tata and they will refinance my vehicle instead. For this, I was asked to go to Takla to show the vehicle as all the documents of me and the nominee wife. According to this, I went to Takkala with the vehicle, on the way, 5 goons stopped the vehicle, physically harmed me, pulled me out of the vehicle and put it on the road and stole the vehicle along with the documents. I immediately called Arun and got a notification that Tata Motors had recovered the vehicle at the Nagercoil branch and asked him to go to the Nagercoil branch to investigate. I called home and my relatives came and picked me up, A complaint was lodged at Thampanoor police station on the same day. After three days, when I contacted the Thiruvananthapuram branch for my documents, they said that they have no knowledge about this and that a person named Arun Chandran is in the Ernakulam branch and they have taken all steps to recover the vehicle from there and they are not taking action to impound the vehicle in the Thiruvananthapuram branch. Also, I came to know that this vehicle has been handed over for legal proceedings from January 2023 and this information was hidden from me. In the month of February, I paid Rs.100000/. At present, the manager of the Thiruvananthapuram branch said that he would take a settlement of Rs. 170, 000 as a settlement. It is said that the period for payment of this amount is 10 days. In my current situation there is no way to pay this amount together. I am ready to repay this amount as a small monthly EMI.I request that action be taken against the persons who stole the vehicle after taking the payment from me without giving correct information and harassing me mentally, physically and physically and to return my vehicle to me in its current condition.
