(b) The complaint relates to:
(i) Unfair trade practice: Service provider did not mention about their authorization status for Canadian immigration consultancy services. Involved in false promises regarding offered Post-landing services and Job-assistance.
(ii) Deficiency in services: Misinformation about various options of immigration. Ill-informed on the document and fund requirements for the Canada immigration.
(c) Texas Review did not provide a detailed itemized bill as per GST ACT 2017, making it impossible to be aware of the charges for the individual offered services.
(d) The provided Representative is not authorized Immigration consultant. In my Canada Immigration Express Entry Profile, filled by the representative it has been mentioned that I am not using any representative or assistance, while I am using the services of Texas Review. This misrepresentation can cause my application to be declined. According to the Immigration and Refugee Protection Act enforced by Canadian government, only authorized representatives can advertise that they can give immigration or citizenship advice. And it is mentioned that “If you use an unauthorized representative, in Canada or abroad, we may return your application or refuse it”.
(e) They promised the Post-Landing services at the time of registration. But at a later date discussing with them regarding how and when they will be providing the accommodation and job assistance they have mentioned that they will provide me a website, which is public, from where I can rent a house, and said they cannot be of any help to me in securing a job by contacting companies or job consultancies behalf of me. These things were not discussed or informed before I paid the fee and signed an agreement.
(f) They did not provide me the complete information of the fund requirements involved. Causing me trouble to arrange the funds at required time. According to the immigration rules funds need to be in the account for at least 6 months prior to the application. While enquired upon how to provide Proof of Funds Texas Review have suggested me to go to a third-party agent who will be charging a 3 percent of the total amount to be shown as proof of funds. Which is illegal and against banking rules.
(g) They did not inform me regarding the available options of immigration. They did not provide me any information on the Atlantic Immigration Program, BC Tech Pilot program, Prince Edward Provincial Nomination Program, and many more such options where timely information would have given me a chance to apply through them.
(h) When I expressed by grievance about the poor quality of service in the month of April, they said that their services will be of great use after receiving the ITA (Invitation To Apply). But, even after the ITA (received on June 12th 2019) I did not see any improvement in the service, pushing me to complain about their services. In the process to find the right channel to express my grievances I came to know that they are not authorized and the payment receipts they have provided are not according to the law.
(i) After receiving the ITA they are saying that I have used all the services that are promised and I am not eligible for a refund. Whereas ITA is preliminary step in the process, after which PR application needs to be sent.
