I was appointed as a software test engineer by unify technologies vide employment agreement dated 17.2.2019. I was serving in the department of engineering delivery. During my tenure, i performed well and contributed substantially in the growth of the company.
Upon their request, i had tendered resignation by email dated 20.06.2019 which was accepted by them immediately on the very next day by email dated 21.06.2019. I was willing to serve the notice period but since they had waived the same, i asked my relieving and experience letter along with full and final settlement amount by email dated 27.06.2019.
After several follow ups, they reverted back to me by email on 01.07.2019 wherein they stated that i will receive my relieving and experience letter within a weeks’ time and my full and final settlement will be done after 45 days.
I had followed up on several occasions regarding non-payment of my salary for the month of june since the date of my resignation. By email dated 07.08.2019, they had illegally adjusted my 21 days salary within the unserved notice period and waived off only 39 days instead of mutually agreed 60 days under the guise of buyout clause.
By an email dated 08.08.2019, i reminded them that no terms and conditions were discussed at the time of my resignation and my notice period was waived off mutually upon their request in lieu of my resignation. By email dated 12.08.2019 they shared with me full and final settlement break up by which they in an arbitrary manner calculated the full and final settlement by quoting the buyout period of 21 days as unserved notice period and waived off only 39 days instead of mutually agreed 60 days.
Thereafter, by email dated 12.08.2019 i sent detailed correct break up and according to which they are liable to make payment of my due salary of 21 days irrespective of agreement. I had been constantly following up with them but my salary has not been credited to my account till date.
