[Resolved]  Vedant Buildcon — refund of full booking amount

Address:Pune, Maharashtra

I booked a flat in arv imperia by paying booking amount cheque of rs 1 lakh on 9th october 2017.
After the booking, i felt a change in sales person's attitude. After few days, my calls and messages went unanswered.
Also, i found that oc of the building has not been recieved.
I also found that the loan amount as expected was not being done - only this is not the sale's person's fault.

Hence, based on above three reasons, i decided to cancel the booking.
But, for one full week, i could not reach the sales-person due to diwali holidays.
The day he said he'll be back, his phone was switched off. Excuse given to me was that the phone got spoilt.

Anyway, the next day i decided to not call and directly visit the office. I asked to cancel the booking. At the time of taking the cheque i was assured that full refund will be given if booking is cancelled. He assured to keep his word and asked me to send an email with cancellation request. I sent email and received an acknowledgement email stating that i'll get the refund within 15 days from the date of this email.

After 20 days i received no call from them. I went to imperia sales-office. Sales person was shocked to see me and asked me to contact the head office directly as he has already forwarded the details and delay is not from his end and he has nothing to do with it anymore. He also gave me a number to call.
This is where the bounce backs begin...

I called this new person from arv head office. He said he can confirm status of the cheque after their meeting which was on the next day.
I called back after 3 days and this guy tells me that the meeting did not happen and they have another meeting today so he'll give me status by evening or morning next day. He also said that the cheque will not be of current date, it'll be of future date, the date he cannot commit.
I called him next day and he simply refused to give me status of the cheque. Said cheque is not ready and he cannot commit for any future date when i'll receive it.in a sense asked me to wait endlessly. When i informed about the 15 day commitment given by sales-person, he simply asked me to contact him as the commitment was given by him.
So, here i am bouncing between the arv's head office staff and the sales person.
Anyway, i contacted sales-person, as usual he did not answer the phone at once. And sent me a sms saying he has not received a response from head office yet, and he'll contact me once he gets it.

This is same head office from where i was told to contact this sales-person.

Hence, i stand clueless for my own money.

Complaint marked as Resolved
I just received the cheque of full amount. It's a PDC for after 20 days but it's okay. Hence, I would like to close the complaint. P.S. I do not know whose fault it was for delaying it so much. I do not blame the sales-person or the staff members.

Update:
I called the sales person today morning. Highly expected, my call was not answered.
After few minutes, I called from another number, the phone was picked I was told that he is with "Sir" and discussing about my payment only and that is why he did not answer my phone the first time. He'll get back to me once he has final info.

No response received despite of this complaint.
I reached out to ABGP which is a non profit organization to provide legal assistance for such scenarios.
They advised me to send them a letter with notice to refund my amount within 7 days keeping them in cc.

Meanwhile, people at ARV still tells me status will be known tomorrow (whenever they pick up my calls...as most of the times it's ignored)

I do not want to post the email copy here as it contains names of those employees and I am not sure out of them and the builder whose fault it is as ultimately they are also just middle class men working for a paycheque, no point in spoiling their names on internet.

Hence, I'll address them from their designation and not names.
