[Resolved]  Bharat City Ghaziabad - Indraprastha Yojna — UNNECESSARY CHARGES BY THE BUILDERS

While purchasing a flat at Bharat City Indraprastha Yojna, UP(B 3-107)(Bharat City Ghaziabad - Indraprastha Yozna, www.bccbharatcity.in, [protected]@bccbharatcity.in) I had applied for loan from HDFC Bank, who was under Business partnership with Bharat City Indraprastha, U.P., at that time. After getting demand letter dated 23.2.2012 of Rs. 891434.00 from said builder I submitted of loan application in the month of Feb.2012 through your authorized agent when it got delayed I enquired to your said authorized agent who in turn told me that the Pre Sanction Survey staff of HDFC came to my office i.e. BHARAT SANCHAR NIGAM LIMITED, CORPORATE OFFICE, JANPATH, New Delhi and asked the temporary guard at the gate whether I am working there or not. The answer was negative from the temporary guard and PSS report became negative simultaneously. I told the loan agent that it was to be asked at the reception. Next time another person came at my office and on the basis of his report my load was sanctioned vide letter dated[protected] and finally got the instalment cheque in June 12, but due to sanction delay in process a demand of Rs. 38, 306.00 placed by Bharat City as late payment at the time of taking possession of my flat, which was not my fault. Further this year in the month of June I went to your Branch, to re-pay Rs. 12 lakh and re-schedule the EMI. It was told that the agreement between Bharat City and HDFC for non-payment of interest is up-to[protected] so I can repay in September. When I paid Rs. 12 lakh in September, the bank charged Rs. 18, 306 as interest which could be avoided if I was told to pay back Rs. 12 lakh in the end of August 2014. Thus due to irresponsible/careless attitude of bank staff/survey staff I have to pay so much extra money as interest. In the above situation I earnestly request you settle my problem entirely due to you and as para no.1 please refrain your co-partner Builder (Bharat City Indraprastha) not to charge delayed interest amounting Rs. 38, 306.00. As para no.2 please credit Rs.18306.00 to my loan account, which is also for your staff negligence. BANK REPLY (Loan from HDFC is sanctioned and disbursed based on the complete due diligence. Due to external factors like employment verification coming negative in the first instance loan sanction is bound to get delayed. Our verification agencies would not have any idea if there is a temporary guard employed. Since the issue came up later and the verification was done subsequently hence the loan sanction gets delayed. The gap between sanction and disbursement date is unexplainable untill unless the property documents were not complete as loan was sanctioned based on your income eligibility and the project was legally and technically cleared so only pendency could have been submission of property documents in original. Regarding the late payment charges being asked at the time of possession-request to kindly take up the matter with the builder that why the same was not asked before(2 1/2 yrs back)" I am satisfied with Bank’s reply but the builder is rigid not to consider the amount of Rs. 38306.00, now I request you refrain the builder not to impose the unnecessary charges.
