Daer Sir, I stay in a co-operative society. Want to know my rights as a member of society as the chairman and secretary makes difficult rules which have no relevance and creat lot of discomfort. Recently they have made a rule regarding use of entrance gate as well which is very vague. also they use security to get them implemented. securtiy guys are merely the puppets in there hands and behave in a very rude manner. I did tried to discuss with them but they are adamant. please guide how can i fight this out as I have paid for use of common amenities and also am paying maintainence on regular basis. rgds..

i am secretary of a society, developed by Guj. Housing board.I have some questions, pl.try to help us.
1-Our society is registered since 1990, and the than former president (for more than 20years) did not gave us any account and we some people took charge for the development purpose. The former president had charged transfer fees from so many society holders for which he is not able to reply for the account.
What can be done under this circumstance?
2- We require indemnity bond form ( for the purpose to issue duplicate share cert)
Can you provide the Indemnity bond form? or guide us from where we can get it?

I am staying in Valsad ( Gujarat) in a society having for size flats 1080, 1350, 1750 and 2000 S. Feet. The society want to paint building and want to collect fund. they have fixed one amount to all the members irrespective of the size of the flat. I feel collection should be pro rata as per size of the flat, You are requested to give comment whether collection is fair. You are also requested to give relevant provisions of Act

I am living in multistory flat at Ahmedabad. I am residing at 4th floor.Now we are facing problems of leaking water from 5th floor in our 3 bathroom as well as in Gallery of kitchen, and of 3 bedrooms. Owners of 5th floor is not repairing as well as not willing to pay any thing .now I want to ask what should I do ?Is any way such as suit filed under civil/criminal laws?Can I have any shelter under guj coop soci act?. our society is regd under Guj co op Housing soci act and regular audit is done .

I would like to know that in registered cooperative housheing society if a member gifts his flat to his wife, is the society liable to charge the member Transfer fees? I s the rule same for Gujarat regarding transfer fees as Maharastra, as as per supreme court max 25, 000/- can only be levied by society pls send me rule at [protected]@hotmail.com .Regards

We are staying in a Society (located in Naranpura-Ahmedabad) constructed in 1969 registered as Housing Society and having total 30 members. Now, there was a proposal for Redevelopment of Housing Society; for which about 23-25 members support the scheme and balance 5-7 members are opposing the scheme giving filthy reasons. Now, considering the age of buildings and dilapidate conditions of the buildings, which require rehabilitation/reconstruction in coming 2-3 years, whether majority members can go-ahead in the scheme and ask the minority members to support the scheme; which is the case in Maharashtra. We have also collected the document pertaining Housing Society Redevelopment in Maharashtra and their guidelines, but we are skeptical about implementation of the same in Gujarat.Therefore, we are seeking your guidance in the matter and wanted to know whether majority members can go ahead for Redevelopment of Housing Society and force minority members to support the scheme and thereby vacate the flats for time being and hand over their flats to the society for redevelopment. I have purchased a flat in 2012. Here the flats owners association was registered under NTC Act. They charged Rs.50, 000/- for transferring the share certificate in my name. Now i understand that NTC Act has been repealed about 10 years back. By implication it appears they have not registered themselves thereafter under any enactment as original name adopted at the time of registration under NTC Act and original registration number continues to be printed on association letter head and payment receipts. I am concerned at this state of affairs. Are they competent to charge transfer fee? If aforesaid facts are correct, is their conduct legally wrong? Please help.

I am purchase flat on November 2013, in Gujarat I have paid stamp duty-registration charged as per Gujarat Revenue act.
We are take NOC from Builders about purchasing the flat
My Share certificate also transfer to my name, from builders
Also I transfer name in 7/12

Now My society have dispute beet win Builders and Society
My Register. Society name is Sankalp co.op.housing society.Ltd.
Builder have no handed over to Mandal
But the Society members made new Madal its call "SANKALP APARTMENT FLATDHARAK MANDAL" its not register.
Mandal are not Given Monthly Maintenance Bill ( Only they take cash/Chaque and Given Receipet.)

Now The SANKALP APARTMENT FLATDHARAK MANDAL are demand me to Pay Transfer fees re's 15000/-other wised pay Maintenance re's 750/- Institute of Rs 500/-
And also they area not ready to given me Demand letter for Transfer fees.

I have request you to give me guide line shod I pay Transfer fees to mandal or not ?

Hello ! I am living in apartment on rent basis ..we are paying our maintenance regularly but we are not getting any information of any happening or any decision taken by society management they don't communicate anything even they don't have notice board where they can put something.

One day early morning I had to go to airport and when I saw the society gate was locked and there was no security guy whom i can ask so after wasting 20 mins finally i broke the lock with solution of buying new lock.Kindly note that I don't have any members contact no.

When I came back in the evening they were waiting for me and they gave me warning in very aggressive manner than I explained them properly that what was the reason behind doing such thing and gave them new lock also, I thought it was finished but next day morning they sent NOTICE to my landlord and also marked this to every member of my apartment, the notice subject was "Nuisance created by your tenant"
I was sent by secretory, he has described me as a criminal and tried to look down in front of every member.

Kindly suggest me what action I can take against him and other commitee members in legal way or with the help of Gujarat co-op housing society act rules / bylaws.

our society is since 1960. our present president sold out the common road, . When he sell the by passing resolution with minimum
