[Resolved]  Gujarat Co-Op Housing Society Act — Rules/bylaws

Daer Sir, I stay in a co-operative society. Want to know my rights as a member of society as the chairman and secretary makes difficult rules which have no relevance and creat lot of discomfort. Recently they have made a rule regarding use of entrance gate as well which is very vague. also they use security to get them implemented. securtiy guys are merely the puppets in there hands and behave in a very rude manner. I did tried to discuss with them but they are adamant. please guide how can i fight this out as I have paid for use of common amenities and also am paying maintainence on regular basis. rgds..

our society is since 1960. our present president sold out the common road, . When he sell the by passing resolution with minimum

I am committee member in society and we all committee body want to know about flat maintenance,

Sir, What is the maintenance of one member but he has two flat and both flats are join with each other ? and member using and demanding all facility in double.

Sir, right now member paying 1.5 time of maintenance.

So let us know about fact to collection of maintenence.

maintenance charge should not more then .025 percent of your flat construction amount that builder have given you in construction agreement cost .

no one can decide amount of maintenance without any logic as per society act suppose 10 lakh for construction of your flat than amount would be 250*10=2500 and that should equally paid in 1 year every month so that will be 2500/12= 208 rs per month maximum for maintenance of your flat.

for any decision 75 % owner of flat or houses should be agree in writing with signature

Dear Sir,

I have a question, does the a society decide by themselves that from tomorrow onward they will not allow bachelors accommodation in a rent agreement, where the guys where already staying for last 3 years & there is not a single complain in past 3 years, Secondly what is the hike in maintenance charges a residential society can charge extra if given to corporate as the society is asking for 3.5 times more than routine charges.

I am member and living in a cooperative housing society in Ahmedabad which is about 45 years old, now entire construction is in dilapidated condition and the same is required to be reconstructed. The most of the members willing to go for redevelopment of entire society, unfortunately some of the members are creating hurdles in such scheme and making unreasonable demands which are impossible to accept. So all I want to know that is there any Act related to redevelopment of old colonies in Gujarat and if yes, please give me the details. I would be highly thankful.

I have list of required information.
1. Our project was registered in 2010, and i have booked my flat in 2011, December. Got possession in 2016, January. Still builder has not finished works in all 3 towers. Water proofing, safety grills and bathroom false ceiling, security office and common passage paint is still due. On asking or complaining, he raises fund issues with his company. What we can do?

2. Also we want to register our society under govt body. (Sangma Village, Padra Taluka, Vadodara District - Gujarat) Whats the procedure and where we can apply? Pls guide.

3. Also garbage collection issue. Big garbage dumping at our compound wall, where villagers intentionally throw their wastes. We have applied many times to the sarpanch of our village, though he is very co-operative person, there is not permanent solution for garbage collection for months togather. The reason sarpanch says is insufficient funds. We have applied to Padra Nagarpalika - they refused to accept the application for the same and dont want to interfere in village sarpanch work. Where we can raise this issue?

4. Also we need your guidance of format to form rules and regulations for society, if you can guide us.

Around year 1970 flat systems came up in Ahmadabad and people started buying and staying in that.All most 50 year has passed.Condition of many flats(constructed in that period) is very poor and not advisable to stay in at cost of life.the condition of flats are deteriorating due to many reasons but main reason is poor maintenance by co operative societies due to lac of cooperation of member and negligence of office bearers of that society
Main reasons are
Water leakage form terrace, parapet and walls due to creaks in plaster and brick work. Nobody wants to pay any attention saying it is problem of a person who is staying on top floor and who is affected and tries to avoid to pay any contribution resulting in rusting of steel used in and pilling of plaster and RCC slab which can fall at any time resulting in fetal accident.

I am also a member of such society but I am not staying in that society and as they are not acting on this problem I have stopped paying maintenance charges after giving verbal notice before couple of years

Please suggest how can I pressurize them either to repair or go for redevelopment.

I am staying in 25 flat building, where there no society has firmed. One flat owner collecting maintanance since last one year but he is not showing any expenses to anyone. Since from last two weeks our power supply disconnected by GB. Due to payment. And now they are telling that we have not sufficient fund to pay a bill. And some of the members are not paying the maintanance.
In this case what should I do.
I always insisted to all the members to firm a society with proper registration, but they are not agree to this.

I am a member of Housing society. Other members park their cars in front of my compund wall. they can as well park their cars near their walls but because they have constructed their walls extending illegally, they are not able to park their cars bear their premises. To my objection, the committee does not take any action because in AGM resoplution to prevent cars at others premises have not been passed as not allowed by interested members and as my family stay major part of the year outside the city, they take advantage though society has common plot where space is available for parking. They was their cars, they spread dirt with the stroke of cloth to remove the dust on their cars which find way in my premises through windows nearby. What can be the remedy ?
