3.0 Narration of the incident
3.1 Against the Ad for Kailash –Mansarover Yatra dated 5.4.2011,sent by the OP through mail, the Complainant alongwith following other family members decided to undertake the Trip at a total sum of Rs 65000/- for each person. (Annexure-1). The team was consisting of :

3.2 That in May 2011 Complainant deposited a sum of Rs 50000/-( Rs 10000/- for each Person)as initial booking amount through cheques with the Opposite Party.
3.3 The OP mailed us an Application Form on 4.5.2011 which was required to be filled up by us .
3.4 The OP informed us over phone that the schedule for our Yatra would be from 19th june 2011 to 3rd July 2011 and requested us to make necessary reservations for our journey from Delhi to Kathmandu & back. Accordingly we booked our tickets on 6.5.11 by flight for reaching Kathmandu on 19th June 2011 and for our return journey to Delhi on 4th July 2011.
3.5 On 15.5.2011, OP informed us through mail that the earlier itinerary stands revised and Yatra now would start from 14.6.2011 instead of 19.6.2011
3.6 14th June 2011 itinerary did not suit us because of marriage of my niece (Dr Garg’s daughter) on 10th June at Mathura. We had to cancel our air tickets loosing Rs 1500/-per person.
3.7 The OP sent us a revised schedule on 6.6.11 through their Mumbai office giving us 6 departure date options. We were to choose any one. On 20.6.11 we gave our consent for the 8th August to 22nd August 2011 schedule. We sought for the confirmation from their side which was cleared by the OP the same day. Accordingly we booked our flight tickets once again on 1.7.11.
3.8 On 30.6.11 we were asked us to deposit the balance amount due from our side to their account.
3.9 The OP got our passports collected through Mr Gopal on 29.7.2011
3.10 That the balance amount of Rs 55000/- by each person was deposited as per the details given below:

3.11 On 4th Aug 2011 we were informed by the OP that again there was some problem in getting clearance from the concerned authorities but also assured us that the same would be sorted out soon .The trip may get delayed by a day or two.
3.12 We were asked to reach Kathmandu as per the original schedule and informed that the total expenses for our extended stay at Kathmandu on boarding, lodging etc would be borne by the OP. Accordingly we reached Kathmandu on 8.8.11 and we were put up at The Everest Hotel there by the OP.
3.13 We had to stay at Kathmandu for three days. Finally on 11th august night the OP informed that the Yatra once again stands cancelled and we could leave to our respective locations.
3.14 OP got our tickets booked for Delhi on 12.8.11. Since the tickets were booked at eleventh hour it cost us Rs 5200 per person. Our earlier tickets for 22.8.11 were low priced ones and non refundable resulting in a loss of Rs 4600 per ticket.
3.15 After retirement the Complainant was working as Consultant on contract basis and entitled to 15 days leave only during a year. In this process heI had to forego 5 days salary also. Dr.Arun also suffered loss for his medical practice for the absence from his H.Q.(Mirzapur).
3.16 On 11.8.11 the OP assured us at Kathmandu that he would be deducting only Rs 5000 per person for the air ticket purchased by him from our total amount of Rs 65000 and remaining Rs 60000/- would be refunded to us within 3 days.
3.17 After reaching Delhi we tried to contact the OP and his staff over phone many a times. His staff told that the money matter would be settled only by Mr Ashok and he himself was always avoiding our phone calls. Once or twice we could contact and talk to him, he again made false promise that within a week we would receive our money.
3.18 After waiting for 15days I sent a mail to the OP on 26.8.11 but it was not responded.
3.19 Again on 20.9.11 I sent one more mail to the OP. The OP replied immediately putting all the blame on us. The OP stated that the Yatra was cancelled from our side hence he would be making a payment of Rs 44800/- to each person against our contribution of Rs 65000/-. It was stated that Rs 5200/-would be deducted for the ticket and Rs 15000/-for our 3 days stay at the hotel in Kathmandu for each person. The payment was to be made by month end . Even this payment was also not made by the OP.
3.20 The Complainant replied to the OP’s mail on 22.9.11 refuting his claim and revisiting the things told at Kathmandu. However, the mail was not answered by the OP.
3.21 After this mail The OP and all his staff switched off their mobile sets and were not approachable.
3.22 The Complainant sent an e-mail on 30.9.2011 as a reminder but it was also not replied.
3.23 The Complainant sent two letters on 26.9.11 and 7.10.11 through speed post at OP’s Ghaziabad address but they could not be delivered. Either they refused to accept or the office was shut down .
3.24 The Complainant could contact the OP over phone in the last week of December 2011. He promised once again that the amount due to us would definitely be paid by 15th Jan 2012. As a reminder to the promise made by the OP, the complainant sent one more e-mail on 31.12.2011.
3.25 Shrestha Treks has inflicted enormous amount of mental agony and huge finanacial loss to the Complainant and his family ( most of them are senior citizens and all non-working as of today).
3.26 Almost 1 year and we are still waiting for refund from Shrestha Treks.
