Subject: Offer of possession for my unit M25/ FF & M25/ Second floor My
floor 2, Kundli, Sonepat Haryana.

Dear Sirs,
Please refer your letter dated 21.5.2013 offering the possession of my units mentioned above in the subject in project My floor 2, Kundli, Sonepat, Haryana, subject to the payment of Rs. 698809/- and Rs. 767038.00. Respectively
In this connection I am to state that ,On perusal of the statement of account annexed with letter refer to above, it has transpierced that your demand is wrong and ill legitimate on the following counts:-
1. That at time of booking i.e. 3sept 2009, the cost of floors was shown Rs. 16.50 lakh for first floor and Rs. 18.00 lakh for second floor plus Rs. 1.15lakh as external development charges calculated on land measuring 200 sq yards @ Rs. 1725 per sq yard which work out as Rs. 345000/- and was equally divided in three floors i.e. 1,19,000/-on each floor.



2. Your statement of account further reveals that the basic cost of floors has now been increased by showing additional construction as 230 sq ft on each floor, making total basic demand as 2116138.70 for first floor and Rs. 2325007.00 for second floor determining the covering as 1130 on each floor. I understand that Haryana urban development authority has allowed 50% coverage of the plot on ground floor with FAR as 150 i.e. 900 sqft = 100 sq yard on each floor.If there is any increase beyond 900 sqft in covered area it is in violation of the BBL as well as of the Master plan which perhaps is not condonable.

Secondly the External development charges which are payable to the HUDA @ 1725 per sq yard has also been shown increased on the basi and on additional coverage of 230 sqft on each floor. Since the external development charges are payable on measurement of the land i.e. 200 sq yard and not on coverage your demand which is Rs. 254251/- and Rs.256051 respectively are all together wrong. Since this is a statutory payment to be paid to the HUDA, a demand letter from HUDA if the rates are revised is must, which has not been provided to me

In view of above, it is requested that a copy of the Sanctioned plan showing the coverage as 1130 sqft on each floor may kindly be furnished to me along with the copy of Letter of demand on revised rate of EDC so that I may make myself satisfied that there is no ambiguity in any way in the demand raised by you and make the payment as desired.

I may further submit that you have mentioned in your letter if the possession is not taken by or before 20.6.2013 the failure will attract refurbishment charges and holding charges till the date of actual possession. The refurbishment charges are stated to be levied for maintenance of the floor till final handing over possession and will attract interest on delayed payment as well.



Consequently, I request you to please furnish me the required documents at the earliest possible so that I may make myself satisfied with the demand for clearing the dues within the stipulated period.

In case the required information is not provided to me in time I would be entitled to claim interest on equal rates basis as are being supposed to be charged from you.

Hope you will consider the matter sympathetically and furnished me the documents at the earliest possible so as to enable me to make the payment and get the possession of floors as stipulated.
