Videocon V1675 — Replacement of the defective handset

I bought a Videocon V1675 Handset on 13/03/2010 from Kolkata.After 2 Days I noticed it has a problem regarding the "Charging". A 1450mah battery was not getting completely charged after 7 hours. Then sometimes it showing "Bad connection with Charger".So, I made contact with service center and they checked my cell phone. After 24 hours they issued DOA for replacement of my handset and asked me to go to my dealer.

Now, the problem is after 10 days my dealer is saying that, he can't replace my handset immediately and I should take back my money excluding the tax amount that is something around Rs.350/-. Then I asked the service center to replace my handset and they have assured me that, they will replace my handset on or after 31st March, 2010.

Why should I pay the tax while I haven't used that phone?

I bought my handset from "Ma Manasa Enterprise". And it has purchased that phone from "Siddharath Infocom". These two shop-owners are fraud because they has harassed me and somehow refused to give the replacement. How did the Company has chosen a shop like "Siddharath Infocom" as a dealer/distributer?

I think there should be some punishable step against these shops and their license should get immediately canceled.
