[Resolved]  YOGESH BOSMIYA — NON-ACCEPTANCE OF CHEQUE

Madam,

Sub:- Refusal of Nationalised Bank’s Cheque (Oriental Bank of Commerce ) towards School Fees of my ward Drashtant Y. Bosmiya, R.B.K. School, Mira Road (E).

Ref:- i) Letter dated 19.02.2009 issued to the Principal R.B.K. School and copy marked to you and received by you on 20.02.2009.
ii) Letter dated 21.02.2009 issued by Oriental Bank of Commerce to you regarding non-acceptance of Cheque of Oriental Bank of Commerce towards School Fees by you.
iii) My Letter dated 22.02.2009 accepted by you on 24.02.2009.


This is reference to the above and it is strange to note that you have refused to accept the fees payable towards admission fee of my ward on 02.02.2009 when I tendered Cheque No. 520082 dt. 30.01.2009 of Oriental Bank of Commerce. The ground narrated by you i.e Cheque is drawn on Oriental Bank of Commerce is totally unconvincing and thereby you have insulted the Cheque issued by the Nationalised Bank i.e a Government of India and thereby violated the RBI guidelines.

I once again personally approached to your branch on 11.02.2009 and deposited the fees in cash, however you have once again refused to accept the same despite of the fact that the said fees towards the admission of my ward, however no reason whatsoever is given to me for such refusal except telling “Sorry”.

Immediately thereafter I approached the school authority for payment of admission fees in cash, the said school authority also refused on the ground that there is a delay in payment of admission fees and the school authority requested me to attend the school on 16.02.2009 and assured that the fees will be accepted on that day. Even I approached on 16.02.2009 to the school authority, same is once again refused on the ground that meeting of the school authority has not taken place and once again I have been asked to attend the school on 20.02.2009.

For the above incident, you are the sole responsible as you are in collusion with the said school authority for promoting your business and thereby forcing the public in general to pay the amount in cash or pay the amount in HDFC bank’s cheque only and thereby indirectly pressurizing public to open an account in your bank which is not only bad in law but also against the directives of RBI.

When I visited your branch for the payment of school fee and you have refused to accept the same without assigning the reason and when I demanded for an explanation as to whether you have any instruction from the R.B.K. School Authority not to accept the cheques of banks other than HDFC Bank, you have not bothered to give proper answer except using the word “Sorry”. Now I hereby, under this Letter call upon you to furnish to me any such communication issued to you by the R.B.K. School as regard to non acceptance of cheque of any other bank other than HDFC Bank. Failure to give proper and convincing explanation which may lead to taking a serious action against you as my son’s admission is at stake.

You are also requested to confirm as to why there is no mention of non acceptance of cheques of any other bank in the paying slip issued by R.B.K. School wherein the name of your bank is printed.

Further, in the said paying slip there is no last date is mentioned as regard to payment of school fees.

In the circumstances, I hereby call upon you explain the above within 3 days and furnish the information sought by me failing which I shall left with no option but to approach the competent authorities against you and also the School Trustees at your risk and cost which please note.

It is pertinent to note that you are accepting the Cheques pertaining to fees payable to C.K. Logistics and Caterers Pvt.Ltd., that too HDFC Bank only.

It is pertinent to note that when I called at about 10.30 a.m today and requested you to give proper explanation to the above incident, you have informed me that you have already replied to the letter of Oriental Bank of Commerce and as regard to other grievances are concerned, you are not bothered and you have further went to the extent of telling me that “What you can do? At the most I may loose my job from the bank”. The said answer is never expected from you specially when I am making grievances of certain procedure adopted by you which is in the interest of general public.

Without Prejudice to the above, I am sending herewith pay order for sum of Rs. 19, 940/- drawn on Oriental Bank of Commerce bearing Pay Order No. 997803 dt. 24.02.2009 and Cheque No. 520098 dt. 25.02.2009 for sum of Rs. 1380/- drawn on Oriental Bank of Commerce towards the school fees payable and I request you to accept the same.

Dear Yogeshji,

I am also of the opinion that HDFC Bank staff of Mira Road branch are not co-operative and rude in behaviour.

I also face once such bad experience in HDFC Bank with regards to Demat Account opening/closing.
