[Resolved]  Visakhapatnam Urban Development Authority — non providing service committed in the application for allotment

Visakhapatnam Urban Development Authority ( VUDA) an Andhra Pradesh State organisation under the admnistrative control of Ministry of Muncipal Administration and Town Planning.
VUDA advertised inviting applications for allotment of Houses in their SHELTER for senior citizens in Sagarnagar, Visakhapatnam. The applicant aged above 60 years settled in Visakhapatnam and willing to stay in the complex should make an application. The application contained various conditions, which included under clause 17 a special condition (1) " unlike other projects in this project the project shall be maintained by VUDA for a period of five years, including painting every two years. Having signed this application and paid the initial deposit the allotment had take place., The project consists of 28 units with gated community, community kitchen, guest rooms, recreation room, Gym, Conference room, solar hot water, back up generator.
The applicants were advised to become members of Society registered by some individual before allotment under societies Registration Act No.35/2001.
In fact Government of AP brought an Act No.29/87, the secure homes aptly falls under this act. VUDA overlooked this and forced all the allot tees to become members of this society before registration of houses in the name of allot tees.While the society added the " maintenance of the project for a period of five years, VUDA conveniently removed this clause from the sale deed. The protest letters submitted did not yield any result.Since the office bearers violated some allotments conditions they did not pursue the matter further.(2) VUDA ultimately agreed that they made a mistake in accepting the society under act No.35/2001, ( in the year 2009) and advised the RTI applicant to take up with concerned agency regarding the registration under Act No.29/87. The matter is now pending with Principal Secretary, Municipal Administration the aspect of registration under Act .

(3) So far five Vice Chairmans have taken charge of VUDA. None of them visited the site. There is no answer from them regarding the maintenance and other service matters like alignment of actual land etc. What is the course of action left to the members?. Can the matter can be filed before the consumer forum or jurisdictional civil court ?. The maintenance Assn can file the petition or the allottees only are required to file the petition. If we take into consideration the cost of land not assigned and the cost of painting every two years the value exceeds rs.20 lacs.
Request please guide us. The five years initial time is since over by 2010. Since protest letters were given during the initial period itself the matter can still be pursued under the provisions of suitable law.
