Sub.: Complaint for Suitable Compensation on Account of Sudden Technical Defect in Clutch Plates of Newly Purchased Honda-City Model-SV Petrol Car with marketed Caption – ‘Peace of Mind, Insured.’
Sir / Madam
Kindly peruse the following facts for further necessary action:
1. I purchased a new Honda-City Model-SV Petrol Car from AKC Motors (Pvt.) Ltd. Ferozepur Road, Ludhiana on 1.5.2014 and had driven only about 3500 Kms.
2. On 9.5. 2015 as we had gone to Chail and Shimla (a hill station in Himachal Pradesh which is about 250 Kms from Ludhiana), for a two day family visit to take a break from our very busy work schedule. When I reached near Sadhu Pul and was driving upwards, the car developed some technical problem and the accelerator stopped picking up speed with the result that the car was hit from one side by a truck causing some scratches and damaging the side mirror. The car became totally immobile and I and my family were totally helpless in unknown area. Then I contacted the helpline number given on the Bonet ([protected]) of the car who in turn asked me to contact toll free number[protected]. I many times called this number and could’t contacts anybody. Then of my own tried to find out the nearby Honda Car agency with the help of the Ludhiana agency and could find out a nearby Honda car agency Lally Automobiles, Kumar Hatti, Solan. But being Saturday the agency was closed. However, we took the car with the help of a pick-up van to Lally Automobiles, Kumar Hatti, Solan (H.P) and insisted for immediate help. The agency people then arranged to replace the clutch plates and we were given the car at midnight. My daughter and other family members were terribly upset and developed serious health problems. We had to abandon all our visit programs and further journey to Shimla and had to come back to Ludhiana.
3. On reaching back I contacted the AKC Motors (Pvt.) Ltd. Ferozepur Road, Ludhiana for other repairs of the car which is in progress with the help of insurance company.
4. However, we have suffered very seriously without any intentional fault of ours as follows:
A. RSA personnel did not help us while we were in terrible situation surrounded by serious danger being in unknown area with my young daughter and other family members around.
B. The brand new car which has just covered about 3500 Kms only has let us down developing a serious technical defect in the clutch plates of the car, though where the caption was: ‘Peace of Mind, Insured’ and we were otherwise carrying a very high image about the Honda City car and presumed that we are driving a safe car. But our trust has been terribly shaken.
C. We had to suffer without any fault of ours, as follows:
i. Repair of Car at Kumar Hatti - Rs. 5000/-
ii. Pick-Up van Expenses - Rs. 5000/-
iii. Petrol charges - Rs. 4000/-
iv. Loss on account of cancellation of arrangement - Rs. 30, 000/-
v. Physically & Mentally Harassment - Rs. 50.000/-
Total - Rs. 94, 000/-
It is, therefore, requested to kindly look into matter seriously and compensate the undersigned innocent customer of a Honda City car who has very badly suffered on account of a technical defect developed in the new Honda City car which has just covered a distance of about 3500 Kms only.
It is further requested to kindly take the appropriate decision into the matter at the earliest and not later than one month from the date of issue of this letter failing which the matter shall be taken further to the public scrutiny and legal relief as per law.
