It is stated that your legal notice is without any basis, unfounded & does not merit any consideration. I am greatly concerned & hasten to reply. In this connection I wish to draw your attention to the following facts. ● Payment for INR 7827 was made vide cheque no. 00256 dated 23rd Feb'21. of ICICI bank dropped at your lok vihar Delhi-34 branch on 21st Feb'21. ●On 6th March I was being informed by your bank that the payment did not reach their end. ● I happened to be out of Delhi & assured that I would confirm the same from my bank once I reach back my hometown. ●On 8th March's you auto debited the amount from my savings account. ● On reaching back Delhi I was confined to my home since my area was cordoned off as containment zone. ● I was haunted by spate of calls thereafter from different nos all posing themselves as Kotak employee. ● They sounded anything but bank employee since they were abrasive, rude, indecent & even abusive. ● They were least bothered about my situation & kept on intimidating me of dire consequences, legal action if I do not make immediate payments. ● It shook me greatly. ● And add to my woes your mail... Let me put it straight that I have no intention to withhold any sort of outstanding dues. ● Me & my family is in the grip of Corona virus with myself on oxygen support. Hence this mail since I am unable to speak much. ● Since Delhi is reeling under lockdown I have to visit my bank to adequately fund my account. ●Being jobless due to this pandemic I have to look for an alternate payment mode...ask for my kith & kin to make payment on my behalf. In view of the above facts you are requested to kindly reverse the accrued LATE PAYMENT CHARGES & let me know the exact amount I need to pay. I am keen to resolve this matter amicably but still if you continue to take this matter legally I am left with no option but to take it as it comes. You are requested to consider my plea & confirm your stand to enable me absolve me off my accountability to clear my debt & relieve me of this ever-growing mental stress & harassment in such TOUGH, TORRID & TURBULENT TIMES. As per the terms and conditions of the Card Holder Agreement and Most Important Terms and Conditions, you are liable to make payments of the various charges, as are applicable for the retention and utilization of the said Credit Card. It is pertinent to mention here that you have been regularly billed by means of the periodical statement (s), issued by the bank in relation to the said Card. You have however, deliberately failed / avoided to adhere to the terms of the payment and your Credit Card account is overdue. As you have failed to make the requisite payments, an amount of 19352.32 is immediately due and a total amount of 89638.93 is outstanding against your above said Credit Card. We understand the hardships faced by you however as per the provisions of the contract and the Bank policies (duly agreed by you at the time of taking the facility), you are liable to make payments for the amounts duly and contractually payable by you. As per the terms and conditions of the facility, in case of default for not paying the outstanding dues, the Bank will consider it as 'Event of Default' and breach of the contract and the Bank in its sole discretion can initiate Civil/Criminal Proceedings against you, for the recovery of its entire dues along with interest and other charges for which you shall be entirely responsible as to the cost and consequences thereof. Even after constant reminders from the Bank, there has been default in payment of the outstanding dues. We therefore call upon you to pay 19352.32 within 24 hours from date/time of this notice failing which Bank shall be constrained to initiate appropriate legal proceedings against you, for the recovery of its entire dues along with interest and other charges for which you shall be entirely responsible as to the cost and the consequences thereof. Please note that by not adhering to the re-payment schedule, you are committing a breach of the terms agreed by you which attracts the invocation of default on your part and unwarranted consequential action with accrual of higher interests.
