Ming Garden — Wrongly levying service tax

I went to this highly reputed Chinese restaurant in my city, varanasi, "ming garden" where I had ordered some food to be packed as a take away. The restaurant charged me service tax on the packed food which is wrong. The fundamental basis of charging the service tax is when you provide a service. But packed foods are not inclusive of any service tax. Despite of various arguments the manager was insisted on his wrongdoings. As an excuse he told me this is how things work here. What was he trying to prove? That they've been wrongly charging their customers service tax and will continue doing that? Outrageous!
